IBAHRI welcomes new Sri Lankan Chief Justice’s commitment to strengthen the rule of law PDF Print E-mail

The International Bar Association’s Human Rights Institute (IBAHRI) welcomes the commitment of the new Sri Lankan Chief Justice, Asoka de Silva, to reform the Judicial Services Commission (JSC) and strengthen the rule of law as voiced in a BBC interview today.
The IBAHRI’s report Justice in Retreat, which followed its fact-finding mission to Sri Lanka earlier this year, expressed concern at the operation of the JSC and recommended reform through the strengthening of its internal procedures and the publication of criteria governing the appointments and disciplining of judges.

Lord Goodhart, who led the IBAHRI delegation, said, ‘The arbitrary and summary use of disciplinary procedures by the JSC and its effect on the morale of the judiciary was an area of significant concern to the delegation. At the beginning of his term in office, the commitment of the new Chief Justice to strengthening the JSC, and the rule of law in general, is positive news and will help to enhance public confidence in the justice system.’

It is crucial to the independence of the judiciary that the procedures governing the appointments, transfers and dismissals of judges are transparent and fair,’ said Justice Richard Goldstone, IBAHRI Co-Chair, ‘We applaud Chief Justice de Silva’s intention to improve the functioning of the JSC and hope that the reforms will help strengthen judicial independence and the administration of justice in Sri Lanka.’
