Wrong to blame Govt in decision to appeal, says NGO PDF Print E-mail

PETALING JAYA: The Bar Council and Human Rights Watch have come under fire for questioning the prosecution's decision to appeal against the High Court's decision to acquit Opposition Leader Datuk Seri Anwar Ibrahim for sodomy.

National Council of the Allied NGOs legal adviser Mohd Khairul Azam, responding to comments posted by both bodies, said it was wrong for them to blame the Government over the appeal.

“What do they mean in saying that the Prime Minister has made a U-turn by allowing the appeal?

“Why blamed the PM? He is neither the Attorney-General nor a judge,” he said.

On Jan 9, Anwar was acquitted by the High Court on a charge of sodomising Mohd Saiful Bukhari Azlan at the Desa Damansara Condominium in Bukit Damansara.

On Friday, prosecutors filed a notice of appeal against the High Court decision.

Human Rights Watch Asia Division deputy director Phil Robertson was quoted as saying in an online portal that it was unfortunate the Govern-ment did not take the chance provided by the trial court judge for it to “bow out gracefully” from Anwar's prosecution.

Bar Council president Lim Chee Wee was quoted as saying in the portal that the people had grown cynical over criminal charges leveled against Anwar since 1998.

Mohd Khairul said such remarks showed that the Bar Council and Human Rights Watch were the ones politicising the case.

“Also, Anwar should not lobby international groups to pressure the country in what is a personal case,” he added.

Former Bar Council president Ragunath Kesavan said the A-G had a right to appeal, in line with the due process of law.
