Trio fail in court bid to challenge Bill PDF Print E-mail

KUALA LUMPUR: PAS vice-president Mohamad Sabu and two others failed in their bid to challenge the Peaceful Assembly Bill 2011 after High Court (Appellate and Special Powers) Judge Rohana Yusuf dismissed it as premature, frivolous, vexatious and an abuse of the court process.

She also ordered Mohamad Sabu, Kuala Krai MP Dr Mohd Hatta Md Ramli and Kuala Selangor MP Dr Dzulkefly Ahmad to pay RM8,000 in costs.

The court held that the application contravened Article 63 of the Federal Constitution as it questioned proceedings in Parliament and it was also an intervention of Parliament’s legislative power.

The application named Prime Minister Datuk Seri Najib Tun Razak, in his capacity as Prime Minister and Pekan MP, and the Government as the first and second respondents respectively.

The trio had sought a declaration that the respondents had exceeded or misused their power by introducing and presenting the Peaceful Assembly Bill 2011 for the purpose of making the Bill an Act.
