Trio allowed to challenge decision over acquisition of their land PDF Print E-mail

KUALA LUMPUR: A couple and a retired professor were allowed to challenge the Government and four others over the acquisition of their plots of land at the Golden Triangle here for the multi-billion ringgit Klang Valley MYRapid Transit (MRT) project.

High Court (Appellate and Special Powers) judge Justice Abang Iskandar Abang Hashim granted two applications for leave for a judicial review after he held that their applications were not frivolous and vexatious.

He also granted an interim stay over the acquisition proceedings until the disposal of two substantive judicial review applications.

The judge made the order in chambers after meeting the parties yesterday.

The couple’s lawyer, David Mathews, said the judge ruled that the applicants had sufficient legal rights to challenge the decision by the authorities over the acquisition of their land.

Their son Colin Yong, who was present in court, said he was happy as his family was given a chance to come to court and explain their stand on the MRT project.

“We are not against the MRT project and willing to co-operate with the authorities for the building of the underground tunnel. There is no need to acquire the surface portion as it is an underground (project),” he told The Star after the decision.
