PETALING JAYA: The Public Prosecutor’s office will not proceed with the trial of 30 Parti Sosialis Malaysia (PSM) members who were arrested recently.

The prosecution unit head in Penang, Deputy Public Prosecutor (DPP) Suhaimi Ibrahim, confirmed that the office decided not to proceed with the matter following representation made by the defence counsel requesting for a review of the case.

“The matter will be called up in court on Oct 10, which is the original date for the commencement of trial.

“We will then apply to the court for a discharge not amounting to an acquittal,” he said yesterday.

PSM secretary-general S. Arutche­lvan said the party was notified of this decision by the lawyers representing the 30 through an email that was sent from DPP Jamil Aripin.

“While PSM is happy with the decision, we are still seeking justice and answers as the A-G’s (Attorney-General) office had not given a full acquittal. The A-G’s decision simply means that they can be charged for the same offence in the future,” he said in a press statement yesterday.

The 30 were detained at the Sungai Dua toll plaza on June 25 while travelling in a bus from Kedah to Penang.

Six of them, including Sungai Siput MP Dr D. Michael Jeyakumar, were re-arrested on July 2 and detained under the Emergency Ordinance after their week-long remand order ended, while the other 24, including three juveniles, were later charged in a Sessions Court in Butterworth.

They were charged under Section 48 (1) of the Societies Act with possessing documents for an illegal assembly and Section 29 (1) of the Internal Security Act with possession of subversive documents.

Arutchelvan said PSM would also seek a meeting with the Home Minister to seek clarification on what he termed as gross violations against PSM comrades.
