KUANTAN: The High Court here has deferred to Oct 6 the decision on whether there should be a judicial review for a group of orang asli seeking to stop development on their land.

The orang asli from Kampung Sungai Buan, Rompin, are seeking to quash the state government’s appro­val of 407.3ha of land in their village for development of an oil palm estate.

Their lawyer Datuk M. Ramachel­vam said Justice Mariana Yahya fixed the date after hearing federal counsel Istisyhad Ismail’s submissions in chambers.

The federal counsel had submitted that the Bakun Dam case should be taken into consideration in the suit.

The plaintiffs, village headman Majid Jaafar and villagers Jentong Duka and Rusman Imat, represented the villagers of Kampung Sungai Buan in naming the Pahang director of Lands and Mines, the state government, the Orang Asli Affairs Department director-general and the Malaysian Government as respondents in their application.

They are seeking a certiorari order to quash the decision of the state government in approving part of the land in the village to Tabung Haji Plantations for the development.

They also want declarations that they are the holders of communal rights to the land and their right to the land not be denied, curtailed or silenced by the state government.
