©The Star (Used by permission)THE elevation of judges to superior courts by the Judicial Appointments Commission (JAC) is done by secret balloting, said Minister in the Prime Minister's Department Datuk Seri Mohamed Nazri Aziz. He said the procedure to elevate judges was carried out in a transparent manner with the appointment based on a majority vote by JAC members. “The commission gives attention by encouraging specialisation and knowledge of the law within the judiciary without taking into account racial background,” he said in a written reply to Karpal Singh (DAP-Bukit Gelugor). Karpal had asked why Indians had not been appointed Federal Court judges although there were many who were qualified in the Court of Appeal. Nazri said the appointment of judges was carried out under Section 23 of the Judicial Appointments Commission Act 2009.
