KUALA LUMPUR: A High Court here has dismissed an application by Kapar MP S.
Manikavasagam to strike out a RM10mil defamation suit filed by a police officer.
Deputy registrar Azhaniz Teh Azman Teh dismissed the application with costs in
his chambers yesterday.
On Sept 4, last year, Manikavasagam, 43, filed an application to strike out the
suit, saying that it was frivolous, vexatious and an abuse of the court process.
The politician claimed that former Sentul police chief ACP K. Kumaran had no
locus standi to bring this action.
He claimed that he had not defamed anyone because he had lodged a police report
on July 27 asking for a detailed investigation into the death of actress K.
Sujatha.
Manikavasagam, a PKR supreme council member, claimed that ACP Kumaran, in filing
the action, had violated civil servants’ regulations stipulated in the General
Orders and the Police Act.
On Aug 8, ACP Kumaran filed the suit against Manikavasagam and three others in
relation to a news report on the death of the actress, which allegedly defamed
him.
