Amendments to the Criminal Procedure Code (CPC) were also tabled yesterday, which allows a document to be admissible as evidence even though the prosecution did not deliver the document before the start of a trial.

Minister in Prime Minister’s Department, Datuk Seri Mohd Nazri Abdul Aziz, who tabled the amendments, said it would also allow the accused reasonable time to examine the document and recall or re-summon and examine any witness in relation to the document.

However, he said to safeguard the interest of the accused, the court may exclude any document delivered after the start of the trial if it was shown that the delivery was deliberate and in bad faith.

Nazri also sought to amend Section 283 of Act 593, which was aimed at providing a more reasonable scale for imprisonment for default of fine payment imposed.

He said with the amendment of Section 396 of Act 593, the court would, with application by the public prosecutor, record the evidence of a witness who was unable to give evidence without causing delay to the court. 

“Evidence from such witnesses are recorded on oath by the court and the witnesses will be examined in accordance with the Evidence Act 1950.”

Nazri said a new section would also be introduced in the bill which would allow an accused, who had pleaded guilty at any time before the start of his trial, to be sentenced by the court.
