©The Star (Used by permission)By M. MAGESWARI KUALA LUMPUR: Kelantan prince Tengku Muhammad Fakhry Petra is suing the police for RM150mil for wrongful confinement after he was stopped from sending a Bentley Brooklands car to his father in Singapore.
Tengku Muhammad Fakhry, who was present at the Jalan Duta court complex here, said he decided to sue the police, describing the incident in 2009 as a “grave injustice and unprofessional”. “I have embarked on legal action merely on the basis of justice and fairness because it is my right as a Malaysian to do so according to the law,” he told reporters yesterday. The prince, however, said he harboured no ill feelings or negative views towards the police. “In my humble opinion, this is the first time since Merdeka that a (then) Ruler’s son sues his own police chief, Kelantan police chief Datuk Abdul Rahim Hanafi,” he added.
The suit was filed at the High Court civil registry through Tengku Muhammad Fakhry’s lawyers Datuk Harpal Singh, A.S. Dhaliwal and Devinder Kaur Dhaliwal. Harpal Singh said the prince only wanted to vindicate himself over the damage done to his reputation. Tengku Muhammad Fakhry has named Inspector-General of Police Tan Sri Ismail Omar, then Kelantan Sultan’s chief personal bodyguard Asst Supt Norazman Ismail, Abdul Rahim and the police as defendants in his suit. In his statement of claim, the prince said he had been requested by his father, the then Kelantan Ruler, Sultan Ismail Petra, on Aug 30, 2009, to send a Bentley Brooklands car to Singapore where he was seeking medical treatment. He said as he was driving towards the gate at Istana Mahkota Kubang Kerian, accompanied by his lawyer Datuk Mohd Haaziq Pillay, he was stopped by the police. Tengku Muhammad Fakhry claimed that there were some 20 to 30 policemen outside the palace gate to stop him from leaving the compound with the car, adding that he would show a video recording of it during the trial. He said ASP Norazman had also prevented him from leaving the palace that day based on instructions from Abdul Rahim and the police. The defendants, who were also carrying firearms during the incident, had wrongly detained him and meant to cause fear in him, added Tengku Muhammad Fakhry. The prince alleged that he was also detained by five policemen for an hour, which put him in fear and caused him to suffer emotional disturbance, anxiety, mental stress and humilation among the royalty. He said the confinement was wrong under the law and unconstitutional. He is seeking RM100mil in general damages, RM50mil in aggravated and exemplary damages, interests, costs and any relief deemed fit by the court. Set as favourite Share Email This Comments (0)
