KUALA LUMPUR: The High Court will hear on Jan 13 an appeal by the prosecution against the acquittal of Batu member of parliament Tian Chua, Pas deputy president Mohamad Sabu and 14 others for taking part in the Bersih illegal assembly in November 2007.
Judge Datuk Ghazali Cha set the date after deputy public prosecutor Ishak Mohd Yusof asked for a postponement of the hearing that was scheduled for yesterday, on the grounds that five of the respondents were not present in court yesterday.
Ishak also said he had yet to receive written submissions from one of the defence counsel, Nazar Khan, and that he needed more time to add more points to his own submission.
Tian Chua, Mat Sabu (as he is popularly known) and Padang Serai MP N. Gobalakrishnan were among 17 people acquitted by the Sessions Court on Nov 19 last year.
The prosecution filed an appeal against the acquittal on Nov 25 last year, citing the reason that the Sessions Court judge had erred in law and fact by acquitting the 17.
One of them, Mohd Asri Ahmad, has since died, leaving only 16 respondents in this case.
