KUALA LUMPUR: Seputeh MP Teresa Kok Suh Sim has filed a
habeas corpus application for her release, saying that her arrest and detention
under the Internal Security Act (ISA) is unlawful.
She filed a notice of motion and a certificate of urgency at the High Court
(criminal) registry here at 12.40pm yesterday through her lead counsel Karpal
Singh. In the notice, Kok, who is also Selangor senior executive councillor,
named arresting officer Deputy Supt E Kim Tien and the Inspector-General of
Police as respondents.
In the document, Kok, 44, asked to be brought to court and be released, and for
any other relief deemed fit by the court.
Her application was affirmed by her father, Kok Kim Tong @ Kok Kum Thong, 74,
saying that Kok was arrested by DSP E at Jalan Awan Cina here on Friday night.
In the document to support the application, he said Kok was held under Section
73(1) of the Internal Security Act 1960 on allegations that she had acted in a
manner prejudicial to the country’s security and that she was involved in
activities, which could cause racial and religious strain as well as conflict in
Malaysia.
Kim Tong, a retiree, said his daughter’s arrest and detention was without basis
and illegal. He contended that the grounds of arrest supplied to the applicant
as required under the same Act and Article 5(3) of the Federal Constitution are
inadequate.
In the certificate of urgency, Kok applied for her case to be heard earlier,
saying that her arrest and detention was done on political intent, arbitrarily
and without any grounds. Kok said her arrest was irresponsible and mala fide.
