Altantuya Murder Trial: 'No proof Azilah was at murder scene' PDF Print E-mail

SHAH ALAM: Counsel for Chief Inspector Azilah Hadri told the High Court yesterday there was no evidence to show his client had been at the scene of the killing of Mongolian woman Altantuya Shaarriibuu.

J. Kuldeep Kumar said there was no statement from any witness to verify that Azilah was at the scene of the murder on the night of Oct 19, 2006.

Arguing that Azilah was actually in Bukit Aman to take his pistol, Kuldeep Kumar said the prosecution could not furnish any evidence on finding Azilah's DNA at the the murder scene or produced any witness who had seen Azilah at the scene.

Azilah, 32, and Corporal Sirul Azhar Umar, 36, both Special Action Unit (UTK) members, are charged with murdering Altantuya in Mukim Bukit Raja, Selangor between 10pm on Oct 19, 2006, and 1am the following day.

Abdul Razak Baginda, 47, a political analyst, is accused of abetting them.

Kuldeep Kumar, who was making submissions at the end of the prosecution's case, said Azilah's girlfriend Lance Corporal Rohaniza Roslan had said Azilah was at Bukit Aman on the night of the murder and the evidence was challenged by the prosecution, which applied to impeach Rohaniza.

During the hearing, the prosecution had tendered evidence that Azilah was at the scene of the murder based on the record of telephone calls traced by Celcom.

"In the circumstances, the inference to the first accused (Azilah) would be that he did not go to the crime scene," said Kuldeep Kumar.

"Therefore, he could not have committed the murder of Altantuya as per the charge."

He said Azilah had never given information voluntarily and there was no record in his notes or on paper of his admission to show the scene of the murder.

"No information was recorded on paper and signed by the accused (Azilah) that he did in fact give those statements," he added.

Submissions before Judge Datuk Mohd Zaki Md Yasin continue today. -- Bernama
