DPP: Azilah and Sirul with Altantuya at time of murder

SHAH ALAM: There was no gap in the prosecution's case in not calling two
witnesses: DSP Musa Safri and a DSP Idris from the Brickfields Criminal
Investigation Department, the High Court heard yesterday.
Deputy Public Prosecutor Tun Abd Majid Tun Hamzah submitted
that there was no need to call the officers to strengthen the prosecution's case
in the Altantuya Shaariibuu murder trial.
He said, based on the evidence of witness Siti Aisyah Mohd Azlan, Chief
Inspector Azilah Hadri had gone to meet Abdul Razak Baginda at Razak's office in
October 2006.
"Musa and Idris would not have known what transpired during the meeting (as they
were not present)."
He also argued that senior investigating officer ASP Tonny Lunggan had
investigated Azilah's movements and his alibi for the night the Mongolian was
murdered.
"The prosecution adduced evidence to disprove his alibi
through Azilah's mobile phone call detail records to show that he was not where
he alleged he was during that period.
"Based on the records, Azilah did return to Bukit Aman on the night of the
incident and then left for the crime scene."
He said the fact that the prosecution proceeded to charge Azilah with the murder
despite his notice of alibi showed that the alibi was not true.
Tun Abd Majid also contended there was no dispute that the doctors could not
tell the time of Altantuya's death.
"The deceased was last seen on Oct 19, 2006, and her remains were found in the
form of bone fragments, tissues and tufts of hair on Nov 6," he said, adding
that there was no way anyone could tell the time of her death.
"We have, however, adduced evidence that she was last seen on Oct 19, while
phone records showed that Azilah was at the crime scene that night."
The cause of death, he added, was ruled as blast related injuries.
Azilah, 31, and Corporal Sirul Azhar Umar, 36, are charged with murdering
Altantuya at Mukim Bukit Raja, Selangor, between 10pm on Oct 19 and 1am the
following day. Razak, 47, is charged with abetting them.
Tun Abd Majid said based on the evidence, Azilah and Sirul were last seen with
Altantuya.
He said the deceased was last seen being taken outside Razak's house.
"Azilah did not come in a police car, he was not uniformed and did not make any
report of Altantuya's arrest."
He said the court should impeach Lance Corporal Rohaniza Roslan's credibility
based on the contradictions between her police statement and her evidence in
court.
He said Rohaniza had attempted to exonerate Azilah of the murder by claiming
that the recording officer did not record what she said in the statement, but
this was not true because she had signed her police statement.
"Therefore, we urge the court to impeach Rohaniza and disregard her evidence."
He also said there was sufficient circumstantial evidence to prove common
intention among the three accused.
This was based on telephone communications between the three, the Touch 'N' Go
and Smart Tag cards found in Sirul's vehicle, Altantuya's bloodstains which were
also found in Sirul's car and the discovery of her watch and jewellery.
"We submit that Altantuya must have been taken to the crime scene in Sirul's car
where she was murdered by Azilah and Sirul."
Submissions before judge Datuk Mohd Zaki Md Yasin continue today.
