No more arrests: Syed Hamid

KUALA LUMPUR: Home Minister Datuk Seri Syed Hamid said he did not order the arrests of the three people under the Internal Security Act (ISA).

He said the action was taken by the police themselves under Section 73(1) based on their assessment of the current situation as they had “strong and good reason” to believe that conflict could happen and public order could be jeopardised.

“Under this action, the police need not refer to me. It’s their discretion and their assessment of what happened. There has been no malice on their part,” he said Saturday at a press conference at Bukit Aman here.

As Home Minister he said he was informed of the police decision but did not interfere with it.

Asked if he thought the police action was justified, Syed Hamid said: “If I start to interfere with the administration of enforcement then it’s difficult.”

“I am a minister. I am a politician. If I start to interfere, then people will say I have a political motive. It will send the wrong signals. I cannot interfere. This has to be done in accordance with the police exercise of their powers,” he said.

Syed Hamid said the police had taken strong notice that there was concern on the ground among the public who felt not so safe as the race issue might result in open conflict and racial fights and some people were even stocking up food.

“People may agree or disagree with the police position but they are in the best position to judge and I think they have done exactly that,” he said denying that the ISA arrests had nothing to do with the Sept 16 date set by Datuk Seri Anwar Ibrahim to take over the government.

He said the current move was not a political move but due to a national threat.

On Friday, the police arrested Malaysia Today editor Raja Petra Kamaruddin, Seputeh MP and Kinrara assemblyman Teresa Kok and Sin Chew Daily reporter Tan Hoon Cheng under the ISA.

Tan was released Saturday afternoon.

Syed Hamid said the police had detained Tan because they had received information that her life was being threatened and there might be possible injury to her and the police wanted to get to the bottom of it.

Tan was the reporter who first reported on Bukit Bendera Umno division chief Datuk Ahmad Ismail’s allegedly racist comments during the Permatang Pauh by-election in which he said the Chinese were “squatters” in the country.

This caused a furore among the non-Malays and led to Umno giving him a three-year suspension for his comments and actions.

Syed Hamid said the police thought it was best to get first-hand information from Tan and thus took her in under the ISA and released her a day later after they got the necessary information and found no reason to hold her.

“I don’t think we are being unfair or that we mistreated her in any way. We acted professionally and after a day released her,” he said, when asked if Tan had posed a security threat in any way.

Asked why the police did not just ask Tan to come in for questioning instead of arresting her, Syed Hamid said it was always difficult when it came to the police when dealing with reporters.

“All of us are subject to the law. When the police feel it is best to bring the person in under ISA, they do so. I think the most important thing is not to exercise unfairness. When they got what they wanted and found they had no reason to hold her and that she’s not a security threat and not disturbing public order, they released her immediately,” he said.

On Raja Petra, he said, the blogger had been given numerous warnings as well as been charged but he continued to create tension.

As for Kok, he said, she had supposedly questioned the sensitive issues such as the azan (call for prayers for Muslims) to be stopped and that could cause ill will and disharmony.

“Based on police work, they have found there has been real fear on the ground because people are worried of what can possibly happen,” he said.

On why Ahmad was not detained for making racist comments, he explained that Umno had already punished him by suspending him for three years and stripping him from the party post while the police was also still investigating a sedition report against him.

When asked why action was not taken against other politicians like Datuk Seri Khir Toyo for racist remarks made, he said people should stop looking at things from an ethnic angle and start thinking as Malaysians.

To a question, Syed Hamid said he did not believe the Government would call a state of emergency because the country was well under control and “we have taken all sorts of preventive measures.”

JOHOR BARU: Home Minister Datuk Seri Syed Hamid Albar said no more arrests are expected under the Internal Security Act (ISA) but it would depend on the situation of public order.

”We are not making arrests just for the sake of arrests.

”We will not make any more arrests under ISA as long as there is no more disturbance to peace and public order,” he said.

He also appealed to all newspapers to cooperate with the Government and not incite negative feelings or sentiment.

Speaking on the one-day arrest of Sin Chew Daily reporter Tan Hoon Cheng, who was arrested under the ISA, he said Tan was detained under Section 73(1) of the Act in order to ensure her safety.

He added that police intelligence indicated that there were threats to her life after she reported on Bukit Bendera division Umno chairman Datuk Ahmad Ismail’s allegedly racist remarks.

“We have no intention of holding a reporter as after all she was just taking notes of the comments made by a certain party that led to a public debate."

Asked on the detention of Selangor senior executive councillor Teresa Kok, Syed Hamid said she was arrested due to her comments on mosques and the Azan recently.

”Her comments have created public disorder and problems,” he said.

Asked whether Kok would be released soon, he said it was up to the police, as they have to access the situation before taking any further action.

If she was in any form of danger, why was she arrested? Shouldn't the police provided protection for her and warned her of any imminent danger?

Simply doesn't make sense! Would the police provide the protection now when she is already out? I hope she would be able to tell the world later.

Are we to believe that the PM and Home Minister had nothing to do with the arrests that took place yesterday? So do they now expect us to believe it was all the police’s own doing?

Do you need to arrest a person under ISA at night and at home just to get information from her? Hasn’t she already given her statement to the police earlier? Could she not just have been invited to the police station on Saturday morning for a further statement, if indeed such “information“ was needed?

It was also reported that the reporter had been taken in for her own safety. Now this must surely be the icing on the cake.

Do you need to arrest someone under ISA to provide her police protection? If so why has Saiful Bukhari (Anwar’s accuser) who I believe is under police protection been given the same treatment.

If there indeed was a threat against her , why hasn’t the police arrest anyone in connection of such a threat? Why for heaven’s sake arrest the victim under ISA?

The reporter has been released in less than 24 hours and without any police protection, so where is the threat now? Has it just “disappeared” as soon as she was arrested and detained?

The reasons given till now for the arrest of the Sin Chew reporter is absolute rubbish.

Please do not continue to insult our intelligence.

But is it any more ridiculous, or sickening, than the following statement made by the minister?

I agree with Dominic Pillai that the reasons for detaining the journalist (under ISA no less) are nonsense. The truth is that it was a warning to all journalists and the news media - a shot across the bow as it were. Tan Hoon Cheng stood by her story and Sin Chew Daily had the gall to stand by its reporter. Now with the threat of ISA hanging over the heads of the media, will they buckle? Or will they show their true mettle in the face of this adversity?

"I am a minister. I am a politician. If I start to interfere, then people will say I have a political motive." --> I wonder why was he offering "explanations" ON BEHALF OF the police then ...

As Home Minister, if the order to arrest did not come from you, are you saying that you are acting under the order of the Police?

If the order to arrest did not come from you, were you made aware of the intention to arrest (by the Police ) before it happened?

Either way, you need to show to us Malaysians that you are indeed a responsible and not indifferent Home Minister. If you are indifferent towards your duty, then UMNO ought to know what to do, if you do not!

Since when the protection of my life can be used as a ground for my detention under ISA? I am not an expert in ISA and I am only a lawyer compared to the Home Minister with his vast years of experience. I would certainly be grateful if the Minister can enlighten me on this "new ground". If my life is threatened, I would now hesitate to lodge a police report!

The Home Minister said that the journalist was detained for her own safety and within the same breath, he said "When they got what they wanted and found they had no reason to hold her and that she’s not a security threat and not disturbing public order, they released her immediately”.

Isn't that contradictory? Or perhaps after questioning her, the threat to her life has been eliminated? Surely this is one of the most powerful form of protection the world has ever known! Police questions me and wah la...the threat is gone!

Didn't the Police questioned her previously in connection to Ahmad's remark? Why during the first interogation, the police could not obtained "what they wanted and found they had no reason to hold her and that she’s not a security threat and not disturbing public order, they released her immediately”.

My simple mind coupled with my not so vast years of experience would come to the inevitable conclusion, rightly or wrongly, that the detention may have been used to intimidate journalists. It may have the unintended consequence of arousing public anger since the journalist was detained for merely reporting what she heard and Ahmad was merely suspended from his party! This act of detention is indeed a threat to national security.

Now Syed Hamid has reprimanded Zaid for not respecting the government's decision in using ISA. So it is a government decision now. That can only mean he was lying to us for good 2 days when he said the ISA arrest had nothing to do with him.

And how can you protect someone by arresting her? And subject her to sleeping on wooden planks and bearing mosquitoes? What B...S...!
