'Accused had opportunity to smuggle explosives' PDF Print E-mail

SHAH ALAM (Sept 3, 2008): Chief Insp Azilah Hadri and Cpl Sirul Azhar Umar had the opportunity to smuggle explosive substances, the prosecution in the Altantuya Shaariibuu murder trial submitted in the High Court today.

DPP Tun Abdul Majid Tun Hamzah, who was replying to the defence’s submission at the end of the prosecution’s case, said there is sufficient evidence to show that explosive substances found at the murder scene came from the Special Action Squad (UTK).

He said Azilah and Sirul had access to the explosive substances and the opportunity to smuggle them out. “We submit that there was no other person from any other security forces,” said Tun Majid.

Tun Majid also said: “No doubt there were contradictions in the evidence of (Chief Insp) Koh (Fei Cheow) and (ASP) Zulkarnain (Samsudin) in this aspect but should their evidence be rejected in total?” asked Tun Majid.

“I don’t deny that they have displayed a cavalier and lackadaisical attitude in performing their duty, which warrants the court to evaluate their evidence with utmost circumspect.”

Earlier, Tun Majid said Koh testified he saw Zulkarnain lodged a police report in respect of the disclosure and that he did not read it. He said Zulkarnain testified that he lodged a police report (the discovery statement).

“However, after being confonted with the original report, he said that he signed the said report but Koh typed it. He further said that Koh typed it and when it came to information, he dictated it to Koh,” said Tun Majid.

“In re-examination, he further explained this and he said that he made a record in his ID in respect of the information given by Sirul in his laptop and Sirul himself confirmed that Zulkarnain was typing something,” said Tun Majid.

Tun Majid also submitted there was no fabrication about the interview or interrogation conducted by Zulkarnain and Koh on Nov 7, 2006, which allegedly led to the disclosure by Sirul on Altantuya’s jewelleries.

Tun Majid said Zulkarnain testfied that both he and Koh interrogated Sirul at 2pm as instructed by DSP Gan Tack Guan. “Zulkarnain was specifically asked about the time Gan gave instruction and his reply was at 12.30pm.

“True, in re-examination Zulkarnain said he stated it at 1.45pm in his ID (investigation diary) because that was the time he received the instruction from Gan. He (Zulkarnain) then said 1.45pm was the time he had commenced his task.”

“It is a contradiction no doubt but how does that amount to fabrication as regards to the fact that the interrogation took place?” said Tun Majid.

He said Zulkarnain lodged a police report in respect of the discovery of the jewelleries and another report in respect of the discovery statement and a search list. (Discovery statement contains Sirul’s alleged statements.)

He said during cross examination, it was revealed that there was another report but with several differences of some particulars.

Zulkarnain explained that it was the original report (discovery statement) he had lodged and he realised there were mistakes and made corrections (which then became another report).

“The prosecutions has explained in detail regarding the inconsistencies and there is nothing suspicious about it. The fact remains that the information was indeed given. Prosecution was not aware of the amendments made,” he added.

The hearing before judge Mohd Zaki Md Yasin continues tomorrow.
