The Committee looks into developments in relation to intellectual property law. Currently the Committee is looking into the following matters:
a) Setting up of an IP Court
The Committee is looking into the pros and cons of establishing an IP Court in Malaysia and the model that the Committee is comparing is that of Thailand and Singapore. In relation to the same the Committee has proposed that a seminar be held to trash out the issues involved in setting up the said court. The Committee is also in the midst of planning a visit to the Thailand IP Court.
At a recent meeting with the IP and Enforcement Divisions of the Ministry of Domestic Trade and Consumer Affairs, the Committee had proposed the setting up of IP Court and the Officials of the Ministry were supportive of the idea.
It was suggested that that the IP Committee submit a memorandum on the said proposal. The Committee will work closely with the Ministry on the proposal of establishing an IP Court. A subcommittee has been established and is currently conducting research on the same.
b) IP Seminar - 'Intellectual Property Update'
The Committee organised a seminar entitled 'Intellectual Property Update 2002' which covered the areas of intellectual property as well as cyber laws and due to the overwhelming response from the members of the Bar, the Committee decided to make it a yearly or bi-annual event.
This year the said update seminar will be held in Kuala Lumpur, Bar Council Auditorium on 28 June 2003 and in Penang on 26 July 2003.
c) Joint Malaysia/Singapore IP Conference
The Committee in the year 2001 on 13 September launched the joint Malaysian Bar Council and the Law Society of Singapore Conference and for the year 2002 the conference was hosted by Singapore. This year it is the Malaysian Bar Council's turn to host the same. Speakers from Singapore and Malaysia will contribute their knowledge in areas of the intellectual property and cyber laws.
Beside the above the Committee was requested to give its views on the Personal Date Protection Bill and had submitted its views to the Law Reform and New Legislation Committee which subsequently was submitted to the Ministry of Energy, Communication and Multimedia with recommendation that the bill be passed by Parliament with appropriate amendments.
The Committee also organises visits to the Government bodies, IP and Enforcement Divisions of the Ministry of Domestic Trade and Consumer Affairs. The purpose of the visit is to introduce the Committee and also request that the Committee be invited to participate in any dialogue in particular involving proposed amendments to the IP laws.
The Committee has also proposed that a round table discussion be held with the relevant Ministry to consider the Madrid Convention.
