On 24 Nov 2010A group of six members of the Bar Council Intellectual Property Committee (“IPC”) paid a courtesy visit to Azizan Mohamad Sidin, Director General of the Intellectual Property Corporation of Malaysia (“MyIPO”).  The visit took place at MyIPO’s new office-to-be, located in UOA Tower, Bangsar.

The objectives of the visit were to:

(1)    obtain updates on proposed amendments to legislation related to intellectual property;

(2)    request that Bar Council continues to be invited to stakeholder discussions on the abovementioned amendments and ample time be given for Bar Council to revert with feedback and comments to the proposed amendments;

(3)    highlight various issues involving the prosecution of applications, including the delay in processing trademark applications when objections have been raised; and

(4)    engage with MyIPO, to propose the adoption of a code of professional conduct to regulate the standards of professional conduct and practice applicable to registered trademark, patent and industrial design agents.

The Director General agreed to look into the matters raised by IPC.  On the proposed adoption of a code of professional conduct, MyIPO suggested that IPC approach, and work together with, Malaysian Intellectual Property Association.

The Director General further said that measures such as recruiting and training new officers, and upgrading of MyIPO’s Information Technology System, are being undertaken to ensure the smooth and expeditious processing of applications.  A fast track system, where approval will be given within 21 months for a clear-cut application (without any opposition), will be launched soon.  At the moment, MyIPO is short of legal officers and is looking to hire those with three to five years’ intellectual property experience.

As MyIPO is in the process of moving to their new office in Bangsar, the Director General gave his assurance that there would be no service disruption during this period.
