The activities conducted by the Intellectual Property Committee (“IPC”) to date included the following:
(1)Seminar on Competition Laws and Policies (24 Jan 2011)
The seminar featured local and foreign speakers with discussions on competition laws and policies. It was attended by approximately 100 participants, comprising Members of the Bar as well as members of the public. Among the topics discussed were the “Basic Understanding of the Competition Act 2010”, “Implementation of the Malaysian Competition Law and Policy, and Functions of the Commissions” and “Getting Started — Basic Moves to Comply with Competition Requirements”.
(2)Courtesy visit to Tan Sri Siti Norma Yaakob, Malaysian Competition Commission (22 June 2011)
The Competition Act 2010 (“Act”) has been passed by Parliament and is scheduled to come into force on 1 Jan 2012. IPC hoped to determine if there would be any guidelines to be adopted by the Malaysian Competition Commission (“MyCC”) in the treatment of intellectual property rights in the Act, and also if there would be any block exemptions for certain agreements (for example franchise agreements). MyCC, at the time of the meeting, was still looking into the preparation of various guidelines and was considering the approaches in other jurisdictions, such as Europe and Singapore, to provide useful guidance.
(3)Courtesy visit to the Enforcement Division of the Ministry of Domestic Trade, Cooperatives and Consumerism (“MDTCC”) (15 July 2011)
Amongst the important topics discussed during the visit were the core features of the new Trade Descriptions Act 2011 (“TDA”), which had been passed by Parliament in June 2011. IPC recorded the concern that the new TDA was passed without seeking consultation and feedback from various stakeholders including the IPC. The Enforcement Division of the MDTCC also informed IPC that they had been utilising the Anti-Money Laundering and Anti-Terrorism Financing Act 2001 against offenders of various intellectual property laws such as the Copyright Act 1987 and the Optical Disc Act 2000. IPC members were also updated on the status and implementation of the “Basket of Brands” scheme initiated by MDTCC. The MDTCC explained some of the advantages for brand owners who would sign the “Undertaking to Cooperate in Completing the Investigation for Infringing Registered Trademark Cases”.
