The Committee looks into laws and procedures involving Industrial Court Practice. Last year the Committee carried out the following events:

a) Workshop on 'Industrial Adjudication Reforms'

The abovementioned workshop was held on 11 May 2002 and it discussed a number of pressing issues affecting the interests of both the employers and the employees and/or their respective unions in relation to industrials adjudication under the Industrial Relations Act 1967. Several proposals were made for necessary amendments to the Act.

Other areas that were touched on were the creation of the Industrial Court of Appeal and the change of name for the Industrial Court.

b) Meeting Between the Bar Council Industrial Court Practice Committee and the President and Chairmen of the Industrial Court'Intellectual Property Update'

The Committee met with the President and Chairmen of the Industrial Court on 6 August 2002 and discussed issues which are contained in the Memorandum entitled 'Industrial Adjudication Reform', inter alia, reforms to the Industrial Relations Act, the Committee's proposal to standardise procedures in the Industrial Court in particular witnesses statements/affidavits of witnesses and recording of evidence of witnesses, uniformity of procedures in the Industrial Court including introduction of documentary evidence.

The Bar Council endorsed the said Memorandum at its meeting held on 7 September 2002 and a copy of the same was personally submitted to the Minister of the Human Resource on 22 October 2002.

c) Meeting between the Office Bearers, the Chairman of the Industrial Court Practice Committee and the Minister of Human Resources

The Office Bearers of the Bar Council and the Chairman of the Committee met the Minister of Human Resources and presented their views on several topical issues including the non-extension of contract of three Chairmen of the Industrial Court, the present unattractive terms and conditions of employment and criteria of appointment. The Minister agreed to set up a Special Committee to review the whole structure of the Industrial Court.

d) Joint Meeting with President and Chairmen of the Industrial Court and Traditional Dinner between President and Chairmen of the Industrial Court and Members of the Industrial Court Practice Committee

A joint meeting between the President and the Chairmen of the Industrial Court and members of the Committee was held on 20 December 2002 and various issues were discussed pertaining to:

i. Practice at the Industrial Court;
ii. Uniform procedures at the Industrial Court;
iii. Witness Statements and Case Management by the President and Chairmen of the Industrial Court;
iv. Witnesses be allowed to give oral testimony in Court and be subject to the three forms of examination of a witness.
It was proposed that a Special Joint Committee be formed to look into procedural reforms at the Industrial Court.

The Committee also organised the traditional dinner between the President and the Chairmen of the Industrial Courts.
