During the year 2009/2010, the Family Law Committee is continuing with its objectives of:
(1) Educating family law practitioners in the relevant court procedures;
(2) Working with the relevant ministries and civil society in monitoring current family law matters and promoting law reforms in the relevant acts and statutes; and
(3) Promoting awareness of family law matters amongst the public.
The Committee had met five times by the time of writing this report. The activities for the 2009/2010 term include:
(1) Meeting with Attorney General’s Chambers and National Registration Department (NRD)
The Committee representatives met with the Attorney General Tan Sri Gani Patail and the NRD on 22 June 2009 to discuss issues such as the status of parties upon annulment of marriage under section 70 of the Law Reform (Marriage & Divorce) Act 1976 (“the Act”), and the need for a decree nisi period for voidable marriages under section 73 of the Act.
(2) Enforcement of Maintenance Orders
An Enforcement of Maintenance Orders Sub-Committee was set up last term to prepare a working paper on the ways and means to simplify and strengthen the procedures, and to consider other means, for enforcement of maintenance orders. The Sub-Committee met three times this term to discuss the relevant acts and to identify the problems of enforcement of the orders. The Sub-Committee is also exploring the enforcement procedures in other jurisdictions, such as Singapore, New Zealand, Australia and UK, to explore options for best practices that can be adapted to the Malaysian system.
(3) Courtesy Visit to Y.A. Dato’ James Foong The Committee paid a courtesy visit to Y.A. Dato’ James Foong, Managing Judge for the Civil Courts, on 3 Sept 2009. Y.A. Puan Suraya Othman, Family Court Judge of Kuala Lumpur, and the Deputy Registrars of Kuala Lumpur and Shah Alam Family Courts, were also present. Several issues pertaining to family court practices were discussed.
