Rule 8. Bar Council or State Bar Committee may proceed with complaint.
(1) Notwithstanding the withdrawal of a complaint under rule 7 and without prejudice to its right to make a complaint of its own motion, the Bar Council or a State Bar Committee may, if it considers there is merit in the complaint, intervene and proceed with the complaint as if it was made of its own motion.
(2) Where the Bar Council or a State Bar Committee decides to proceed with a complaint under subrule (1) -
(a) the Director shall enter that fact in the Complaints Register;
(b) the requirements of subrule 3(3) shall be deemed to be satisfied;
(c) subrule 4(2) shall not apply to require any refund of the processing fee paid.
