Fines 1. (a) En. Sabri Bin Ahmad (Serial No. S/200) (b) En. Iskandar Zulkarnain Bin Zainal Abidin (Serial No. I/082) DC/09/4627 By ASDB Order dated 9 October 2010 the 1st Respondent of No. 37, USJ 3A/5, 47600 Subang Jaya, Selangor was, after taking into account mitigating factors, fined RM2,000.00 for failing to adequately supervise the firm’s branch office resulting in the Complainant’s file going missing and the complainants cause of action becoming time barred. The 2nd Respondent of No. 419, Lorong 5/1, Taman Angsana, 09000 Kulim, Kedah was, after taking into account aggravating factors, fined RM5,000.00 for the same misconduct, in that he was the advocate and solicitor in charge of that particular firm’s branch and the file in issue. 2. Mr. Shanmugaraj a/l Chelliah Thamotherampillai (Serial No. S/403) DC/08/4261 By ASDB Order dated 8 October 2010 the Respondent of No.92, Lorong 6/30B, Section 6, 46000 Petaling Jaya, Selangor was fined RM3,500.00 for breach of Rule 56 of the Legal Profession (Practice and Etiquette) Rules 1978 and reprimanded for breach of Rule 42 of the Legal Profession (Practice and Etiquette) Rules 1978 by communicating with the Complainant’s client. 3. Ms. Magdline a/p Hector Gomez (Serial No. M/396) DB/09/5055 By ASDB Order dated 8 October 2010 the Respondent of No. 56, Jalan USJ 5/1, 47600 Subang Jaya, Selangor was fined RM500.00 for breach of undertaking for failing to ensure that the vendors settle the sums due and outstanding to the management and giving an undertaking to that effect when she was not in the position to ensure that it would be honoured. 4. Mr. Su Thiam Huie (Serial No. S/307) DC/07/3495 By ASDB Order dated 8 October 2010 the Respondent of B2-03-2, Bukit Utama 1, No. 3, Changkat Bandar Utama, PJU 6, Bandar Utama, 47800 Petaling Jaya, Selangor was fined RM3,000.00 for misconduct under S 94(3)(i), (n) and (o) of the Legal Profession Act 1976 for allowing his staff to deal directly with the Complainant and receive cash payments from the Complainant without any supervision by him. 5. En. Zainal Azahar B Mohd Zain (Serial No. Z/012) DC/08/4186 By ASDB Order dated 9 October 2010 the Respondent of No. 120, Taman Intan, Bakar Arang, 08000 Sungai Petani, Kedah was, in view of mitigating factors, (i.e. there was no fraud or dishonesty fined RM2,000.00 for making unauthorized alteration on a transfer form without the Complainant’s consent.
