Court Liaison Committee 2010/2011 Interim Report PDF Print E-mail
During the 2010/2011 term, the Court Liaison Committee is continuing with its primary objective of looking into the needs and problems encountered by Members of the Bar in matters relating to the administration of Courts.

The Committee has had three meetings at the time of writing this report.  The activities planned for the 2010/2011 term included:

Meeting with President of Court of Appeal

Alex de Silva and Mohamed Zaini Mazlan, Committee representatives, together with Lim Chee Wee, Malaysian Bar Vice-President, met with Tan Sri Dato’ Seri Alauddin bin Dato’ Mohd Sheriff, President of the Court of Appeal, on 13 May 2010 to discuss issues relating to Practice Direction No 1/2010 and No 2/2010 on the disposal of appeal cases pre-2008.

Meeting with Chief Justice of Malaysia

Ng Kong Peng, the Committee Chairperson, together with the four Office Bearers and Council members, met with the Chief Justice of Malaysia (CJ), Federal Court Judges (YA Tan Sri Dato’ Zulkefli bin Ahmad Makinudin, YA Tan Sri James Foong Cheng Yuen and YA Dato’ Seri Md Raus bin Sharif) and Court of Appeal Judges (YA Datuk Suriyadi bin Halim Omar and YA Datuk Ramly bin Hj Ali) on 3 June 2010.  The meeting was held to discuss several issues and problems faced in courts by Members of the Bar, which include, among others, the direction from the CJ that courts begin sitting at 8:30 am, the lack of written judgments by appellate courts, and mediation.  A set of specific complaints that had been forwarded to the Secretariat by Members of the Bar was handed over to the CJ during the meeting.  The CJ said that he would revert after looking into these specific complaints.

Meetings of Jawatankuasa Kerja Pentadbiran Keadilan

GK Ganesan, the Committee Deputy Chairperson, attended the meetings on 3 June 2010 and 15 July 2010 as representative of Bar Council.  During the meetings, the proposed Combined Rules of Court, the proposed Mediation Act and the National Legal Aid Foundation, among others, were discussed.

Memorandum on Use of Witness Statement

Among the issues that have been discussed by the Committee is non-standardisation of practice in court on the use of witness statements.  In view of this, the Committee has prepared a memorandum on the use of witness statements and general guidelines with regard to witness statements.

The Committee also looks into complaints received by Bar Council on issues relating to administration of courts.  Some of the complaints received this year relating to state-level issues were referred to the respective State Bars for more efficient and prompt resolution.  Other complaints were discussed at Bar Council level and where appropriate, were conveyed to the Chief Justice during the regular meetings between the Chief Justice and the Council/Office Bearers.
