CCLC has established the following sub-committees to provide specialist focus on the various areas involving corporate and commercial law:
* Securities Commission Sub-Committee
* Companies (Amendment) Act 2007 Sub-Committee
* Bank Negara Sub-Committee
* Companies Commission of Malaysia (CCM) Sub-Committee
* Bursa Malaysia Sub-Committee
* Registration of Prospectuses and Readable Prospectuses Sub-Committee
* Takeovers and Mergers Sub-Committee
The sub-committees are constantly engaging the relevant authorities in their areas of focus. In this sense, CCLC and its various sub-committees regularly deal with Bank Negara Malaysia (BNM), Jabatan Insolvensi Malaysia (JIM), Malaysian Institute of Accountants (MIA), Bursa Malaysia, Association of Banks in Malaysia (ABM) and CCM.
Currently CCLC is involved in the following projects:
(1) Limited Liability Partnerships (LLP)
CCLC, together with the Legal Profession Committee and the Professional Indemnity Insurance Committee, have been the driving force behind the LLP Task Force. The Task Force was specifically set up to review and comment on the CCM Consultative Document on LLPs in Malaysia. The LLP Task Force has dialogued with MIA and the Malaysian Institute of Certified Public Accountants (MICPA) on the issues surrounding LLPs. Through the Task Force, the Bar Council will be able to monitor the passage of the proposed LLP Bill.
(2) CCM Corporate Practice Consultative Forum (CPCF)
CCLC is continuously involved in the CCM CPCF where professional bodies discuss policy and operational issues, amendment of laws, legal interpretation of company law provisions, and practice notes for matters pertaining to company law.
(3) Malaysian Mediation Centre (MMC)
CCLC is currently assisting the Bar Council study the viability of turning MMC into a company limited by guarantee.
(4) Roundtable Discussion with ABM
On 8 Oct 2009, CCLC sent its representatives to a Roundtable Discussion with ABM on issues that lawyers face when dealing with ABM’s members. ABM agreed to look into the issues that were raised.
(5) Courtesy meeting with the Director-General of JIM
The courtesy meeting between CCLC and JIM on 10 July 2009 was a fruitful platform for threshing out outstanding issues and requests by both sides. A courtesy letter was sent to the Director-General stating the Bar Council’s stand on matters pertaining to insolvency matters and private liquidators. A reply was received on 17 Nov 2009 whereby JIM promised to consider some of the points raised at the meeting.
