During the year 2009/2010, the Conveyancing Practice Committee (CPC) will continue with its primary objects of:

i. providing assistance and guidance to Members of the Bar and the public on matters pertaining general conveyancing practice;

ii. monitoring breaches of the relevant Rules and Rulings of the Bar Council and recommending disciplinary actions wherever appropriate;

iii. enhancing the standards of conveyancing practice in Malaysia; and

iV. bringing about legislative reforms to the property industry.

To provide a better and faster response to enquiries, the CPC has introduced a Query Form for Members of the Bar and the public when submitting enquiries. This Query Form, completed properly, will contain all information and details necessary to enable the CPC to straightaway provide a well-considered view, without having to request for further particulars from the enquirer.

Currently the CPC is involved in the following projects:


1. PEMUDAH Focus Group on Registering Property in Malaysia, which has been set up by the Prime Minister’s Department to improve the process and enhance transparency in registering property;


2. Task Force on Revival of Abandoned Housing Projects set up by Jabatan Perumahan Negara to look into the effectiveness and enforcement of the Housing Development (Control & Licensing) Act 1966, the Strata Title Act 1985 and the Building and Common Property (Maintenance & Management) Act 1966;


3. On-going discussion and collaboration with the House Buyers Association (HBA) to present a joint memorandum to the Ministry of Housing and Local Government on proposed amendments to the Building and Common Property (Maintenance & Management) Act 2007;


4. Working group set up by the Ketua Pengarah Tanah dan Galian (KPTG) on implementing a workflow for strata titles to be issued with vacant possession/Certificate of Completion and Compliance (CCC);


5. On-going dialogues and discussions with the Stamp Duty Division of Lembaga Hasil Dalam Negeri (LHDN) on the implementation of e-Adjudication and STAMPS (Stamps Assessment and Payment System). The CPC held two training sessions on STAMPS at the Bar Council Auditorium in July 2009, which were conducted by LHDN personnel to guide Members on how to effectively use the various websites for online stamping;


6. Considering and preparing a report and advice to Members on the issue of blanket undertakings and whether a claim on such undertakings are covered by the PII Master Policy;


7. The revival of the Sub-Committee on Simultaneous Settlement of Multi-party Transactions to make recommendations on a one-settlement date for conveyancing transactions; and


8. Intense preparation for a soon-to-be-held dialogue with the Association of Banks, Malaysia.
