PETALING JAYA (May 22, 2013): Human rights group Amnesty International (Amnesty) has called on the government to repeal Section 124(B) of the Penal Code which provides a maximum 20 years' jail sentence for individuals convicted of involvement in any  activity detrimental to parliamentary democracy .The London-based watchdog group said Section 124(B), which came into force in June last year, is  overly broad and vague . The provision imposes a chilling effect on free expression in violation of Malaysia's constitution and international legal obligations,  said Amnesty in a statement. It (also) gives the police officer absolute discretion to arrest and detain individuals deemed to have committed any act detrimental to parliamentary democracy,  said Amnesty.The statement was released following the arrest of student activist Adam Adli Abdul Halim on Saturday for violating Section 4(1) of the Sedition Act and Section 124(B) of the Penal Code.</description>

KUALA LUMPUR: Police have classified the death of a man while in a lock-up on Tuesday as murder.City police chief Datuk Mohmad Salleh said a post-mortem at Kuala Lumpur Hospital revealed  criminal elements  present in the death of N. Dhamendran, 32, an Alam Flora lorry driver.He was arrested in connection with a shooting incident in Bandar Tun Razak last week. The case has been forwarded to (federal police headquarters at) Bukit Aman and we have received instructions to classify the investigation under murder,  he said in a statement.Police had initially classified the case as sudden death as Dhamendran had collapsed after complaining of chest pains. They had believed he had suffered an asthma attack followed by a heart attack.Earlier, Dhamendran's wife of four years, Mary Soosay, 26, said she was unconvinced that her husband died of a heart attack.</description>

PUTRAJAYA: Attorney-General Tan Sri Abdul Gani Patail says the prosecution will proceed with statutory rape charges against 40-year-old restaurant manager Riduan Masmud.He said the prosecution had never dropped the charges even though the 13-year-old girl the man allegedly had sex with and subsequently married had withdrawn the rape report against the father of four.“We do not tolerate any kind of statutory rape and we have always taken a hard stand on such offence.“I have directed my officers to gather more evidence including the DNA report and a report on the girl from the Social Welfare Department.“I have also asked the investigating officer to prepare an assessment report on the girl,” he told a press conference here yesterday.Riduan was charged on Feb 28 with statutory rape of the girl inside a car parked by the roadside in Inanam near Kota Kinabalu at about 10am on Feb 18.</description>

PETALING JAYA: Syariah lawyers want the Islamic affairs authorities to act against the 40-year-old man who married a 13-year-old girl he had allegedly raped.“We urge the syariah authorities to do the necessary to charge the wrongdoer as a lesson that marriage is not a way out for adultery or rape,” said Syariah Lawyers Association secretary-general Moeis Basri.He said under syariah laws, sexual intercourse outside marriage is considered an act of adultery even if the girl consented to it.Moeis said the man also needed to get the consent of the girl's legal guardian as well as permission from the Syariah Court before marrying the child as she is below 16 years old.Moeis hoped the Attorney-General's Chambers would proceed with action against the man, adding that the civil court had better jurisdiction and severe punishment for rape cases.</description>

KUALA LUMPUR, May 22 — A High Court’s decision to throw out the maiden charges filed under the Security Offences (Special Measures) Act showed that authorities must come to terms with the loss of arbitrary detention powers they once wielded before the repeal of the Internal Security Act (ISA).On Monday, Justice Kamardin Hashim ordered Yazid Sufaat and his friends, Halimah Hussein and Muhammad Hilmi Hasim, to be freed after allowing their applications to strike out the charges made against them for “inciting unrest” in Syria..When handing down the judgment, Kamardin said the court was satisfied that there was merit in the submission by the defence pertaining to the charges and the application of the Security Offences (Special Measures) Act (SOSMA) 2012, which was enacted under Article 149 of the Federal Constitution.In his judgment, Kamardin said Article 149 of the Federal Constitution was only applicable for acts of threats in Malaysia.“Since the charges against them involved offences committed in Syria, Article 49 and SOSMA, which is enacted under Article 149, cannot be used to prove the charges against them,” he added.</description>
