This is my views only, and I will formally put this to the Council soon.
My views on the unnecessarily prolix and convoluted process of applying for SA is noted [please see my posting on website]. First, the Council must evaluate the issues I raised therein.
Context: Must we explain in SD of ‘gaps’. The dates of reporting to and resignations from firms are usually correct because they are verifiable on record. What usually is asked of an applicant lawyer is “what did you do between this firm and that firm [for example a 13-day gap]. This is crazy.
Who and what is BC to ask an advocate & solicitor of that? BC wants to hear the word 'unemployed'. Are you kidding me?
The correct translation for ‘unemployed’ is ‘menganggur’, a less than appropriate word in BM to say when a lawyer is gainfully employed [could well be within leave period] but comfortably at home and in the midst of moving from one firm to another. Does the BC expect the lawyer to say [eg] 'between 3 February to 9th February "saya menganggur”?'
This may appear small, but something has to be done to correct this seemingly long standing mistake, in my honest view.
In any case, that is the gap that an applicant for SA should or should not mention in the SD such as ‘watching tv with my mom, and waking up late in the noon’ for those ‘gap days’ – that is, if the BC still insist on the completely unnecessary. Such requirement is simply silly [see below].
Do note of course, if an applicant has been away for decades and suddenly applies for SA, that is a different court room altogether.
