Scope of meaning of the word "differences" - 2007/10/13 14:27 The parnership agreement says "all matters of differences in relationship to the partnership affairs shall be referred to two arbitrators". (Letters of) demand has been made against the other partner who then did not respond. Looks like since there is no response from the other partner, there is no differences (as under the agreement)and hence no arbitration is required and one partner can then commence civil suit against the defaulting partner. Could any member opine as to that even so, arbitration is still required? not required?
