Housing Development: state's power to impose Malay quota - 2008/10/23 16:30 The Kedah state government’s recent decision to increase ‘Malay quota’ imposed on sale of housing units in housing projects has received much criticisms and protests from the local developers and some members of the public.

Whilst the state government whether BN or PR led think that it is their prerogative to impose such quota upon approval of applications for conversion/subdivision of land for development purposes, I wonder under which provisions of the law in particular the National Land Code, 1965 such power is being exercised.

The relevant provision relating to 'Variation of Conditions.....'under s 124, NLC does not seem to confer such power on the state authority to do so.

The state authority’s decision to impose such quota seems to be a policy decision rather than a legal one. If so, wouldn’t such condition be ultra vires the NLC (assuming no provision therein confers such power) and is null and void?

Would appreciate your views on the matter.

Your suggestion, if true in meaning, will be real 'economy' - simply so 'sweet', so 'simple' and so 'sincere'; but as for me, I will not want to buy any - so as to avoid mosquitoes from breeding, and 'denggi' from spreading.
