KL Bar YLC- Aid Legal Aid Month - 2007/09/08 23:20 Dear all (and in particular KL Lawyers)

Last night, the Human Rights Unit of the KL Bar YLC launched a campaign to promote Legal Aid. Called "Aid Legal Aid", this campaign will run for a month from Sept 7 to Oct 7 and essentially will focus on promoting legal aid to lawyers.

There are many lawyers who have been called to the Bar in the past few years and likewise the number of legal aid cases have also increased tremendously. Thus, the Human Rights Unit feels a campaign to promote and create awareness for legal aid is most apt this time.

The Human Rights Unit has, on its own initiative, and with support of a few, printed 250 badges with words "AID LEGAL AID". These badges are available at the KL Bar secretariat and I urge members to wear them as a sign of willingness to promote and create awareness for legal aid cases.

We have got special dispensation from the KL Courts for lawyers to wear them on the lapels of their jackets for the campaign period.

More importantly, we hope lawyers will take on only ONE file a year. I am aware of the busy schedules, financial targets and other considerations, but I urge lawyers, young or old, who have not taken up any legal aid cases to do so. Only ONE file and it will make a big difference to the Legal Aid Centre and the beneficiary of your assistance.

Re:KL Bar YLC- Aid Legal Aid Month - 2007/09/11 10:37 Just to add to Dipendra's message, the legal aid centre informed the KL Bar YLC that their greatest need is for more volunteers to take up criminal files. so in addition to distributing the 'Aid Legal Aid' badges in court, members of the KL Bar YLC will be armed with clip boards and volunteer sign up sheets to make it easier for lawyers to aid legal aid.

Re:KL Bar YLC- Aid Legal Aid Month - 2007/09/14 16:35 Just a feedback after wearing the lapel on my jacket for the morning and afternoon court sessions today. I must thank Janet Chai for this.

The lapel has indeed drawn the attention of my learned colleagues in court and a few have commented on it. In some ways, this has raised the awareness or rather reminded some lawyers that legal aid exists and that it needs help.

So thumbs up for the initiative. Don't be shy to wear one when given.

Another note of mine is that maybe the design of the lapels can be improved so that more attention can be drawn to them. Not over the top, but better wording on the lapels themselves.

Re:KL Bar YLC- Aid Legal Aid Month - 2010/07/21 09:34 Appreciate if someone can provide some statistics on the number of files opened and fees collected and whether feasible to meet clients at the Legal Aid Centre explaining to them the expenses that may be incurred that may take more than what the applicant is paying.

Until today, the legal aid scheme has operated on a voluntary basis.

When it comes to financing legal aid, the tasks is much unresolved since a large portion of the legal aid costs are either borne by the applicant or in some aspect, shared between the applicant and the solicitor.

Such pro bono work is not given adequate remuneration since the case matters may vary from difficult to very complicated issues involving different laws.

If so, where do we draw the standard for fees charging on pro-bono voluntary work basis ? Not provided in the solicitor rules nor the court rules.

This is a shame for the Bar Council since the subscription collected over the years were never put to a specific form of allocation for the work involved, especially, when the growing number of files such as legal aid matters is a continuous workload every year.

In other words, you cannot continue a scheme without a foundation to support financing legal aid by over replying on voluntary pro bono basis.

Hope such a foundation to finance legal aid not only in one centre in one state but for all states can be better monitored and specifically drawn to better serve the interests of genuine applicants.

Hence the corrected paragraph 7 should read;

"In other words, you cannot continue a scheme without a foundation to support financing legal aid by OVER RELYING on voluntary pro-bono basis."

Hope someone can take up from here to the respective parties to draw up a foundation plan soon.
