Overview
When an employee/workman is dismissed or considers himself to be dismissed, the workman may file a complaint under S.20 arising from the said dismissal.

It is this filing of the complaint by the workman that triggers off a whole chain of events that will result in the matter being referred to the Industrial Court for a hearing and the eventual handing down of an Award.

The employer, of the concerned workman, in order to rebut the claim for unfair dismissal, must show that the dismissal was with just cause and excuse and the employee that it was without just cause and excuse.

This seminar will discuss the requirements that need to be satisfied, by both parties, in order to succeed. In addition, participants will be taken through, step by step, as to the procedures and requirements, from the filing of the initial complaint, to the reference, by the Minister of Human Resources, of the complaint, to the Industrial Court.

Mr. Ajit Singh Jessy and Mr. V. K. Raj will speak on the subject. Both the speakers appear at the Industrial Court regularly. Their approach will be to stimulate and encourage active participation through question and answer session.

This seminar will be useful for lawyers who appear at the Industrial Court, as well as those who intend to and should provide a better understanding of the requirements of S.20 of the Industrial Relations Act 1967.
