A Roundtable Discussion on Access to Justice was held at the Bar Council Auditorium on 17 Nov 2009. A total of 28 participants attended the Roundtable including representatives from the Ministry of Human Resources, the Ministry of Foreign Affairs, the Ministry of Women, Family and Community Development, foreign missions and NGOs.

The Discussion was organised by the Subcommittee on Migrants, Refugees and Immigration Affairs, which is chaired by Dato’ M Ramachelvam. This Discussion was organised following rising concerns of the difficulties faced by migrant workers in trying to secure their rights.

The Discussion began with a welcome address by the Chair, followed by three paper presentations. The first presenter was K Kesavan, representative from the Labour Department, Ministry of Human Resources, who presented a paper entitled “Labour Dispute Involving Foreign Workers”.  He outlined current legislation safeguarding foreign workers, dispute and settlement mechanisms, and current initiatives undertaken by the Labour Department to ensure foreign workers are protected.

Dr Irene Fernandez, Executive Director of Tenaganita, shared her views on “Access to Justice – Case Studies”. Her paper discussed the various complaints received by Tenaganita in relation to foreign workers who face a lot of problems in pursuing legal remedies in Industrial Courts.

Last but not least Muhendaran Suppiah, a Member of the Malaysian Bar, in his paper entitled “Access to Justice – Fundamental Right”, explained about the law in relation to foreign workers. On the issuance of the special pass, he suggested amending the terms and conditions to benefit the foreign workers and help them remain in the country to pursue their claims.
