Contributed by Richard Wee & Yip Xiaoheng The Bar Council’s team of solicitors at the Royal Commission of Inquiry (“RCI”) investigating Teoh Beng Hock’s death (“RCI-TBH”) will provide regular updates on the proceedings. For ease of reference, all reports will bear the heading “RCI-TBH”.
26 Apr 2011 – Day 44 continued with the testimony from Ahmad Shafik Abdul Rahman, Acting Superintendent, who took over the Selangor Malaysian Anti-Corruption Commission (“MACC”) investigation on 27 Aug 2009. During his examination, Ahmad Shafik revealed that investigation against Teoh Beng Hock’s employer, YB Ean Yong Hian Wah, Ahli Dewan Undangan Negeri (“ADUN”), showed that the government projects in the Seri Kembangan constituency had been completed in 2008. Ahmad Shafik also told the RCI that there was no testimony that could link YB Ean Yong to any wrongdoing under Section 18 of the MACC Act. The investigation showed that claims made by YB Ean Yong and the payment to the Democratic Action Party (“DAP”) branch had been for reimbursement for advance payment to the contractors based on Lee Wye Wing’s testimony. Ahmad Shafik added that there was no documentary evidence to support that.
Furthermore, Ahmad Shafik explained that Datuk Mohd Shukri Abdull, former MACC Investigations Director and current MACC Deputy Chief Commissioner, had given instructions not to pursue investigations on the payments received by DAP. The RCI-TBH proceeding was adjourned at 5:45 pm and will recommence at 9:00 am on Wednesday, 27 Apr 2011.
