RCI-TBH (Day 43): Witness Admits Pulling Back the Window After Seeing Body PDF Print E-mail

The Bar Council’s team of solicitors at the Royal Commission of Inquiry (“RCI”) investigating Teoh Beng Hock’s death (“RCI-TBH”) will provide regular updates on the proceedings.  For ease of reference, all reports will bear the heading “RCI-TBH”.

25 Apr 2011 – Day 43 continued with testimonies from Celcom representatives and six other Malaysian Anti-Corruption Commission (“MACC”) officers.

The RCI began with the examination of Celcom representatives.  The purpose of these witnesses was to ascertain whether Celcom, as a telecommunication provider, kept its customers’ SMS contents.  It was revealed that Celcom did not store any contents, but merely a record of the transactions.

The RCI then continued with the MACC officers taking to the witness stand.  Among the important witnesses were Khairul Anuar and Mohd Najeib.

Khairul Anuar testified regarding his role in the 52/09 MACC investigation.  He explained that he had gone to the location where Teoh Beng Hock had allegedly fallen off from to have a cigarette between the late hours of 15 July 2009 and the early hours of 16 July 2009.  He also testified that the latch of the alleged window had been present and not broken.  In his statement to the police, Khairul Anuar had said that the window latch was intact.

Under examination by Cheow Wee, counsel for Bar Council, Khairul Anuar maintained that the window latch had not been broken after Teoh Beng Hock’s death although he was shown a photograph of the broken window latch.

Khairul Anuar also strongly denied any involvement in the alleged abuse cases in MACC despite being positively identified as the aggressor by several complainants.
 
Mohd Najeib later took to the stand as he had been the officer who had downloaded the four unsigned invoices from Teoh Beng Hock’s laptop.

During examination, Mohd Najeib testified that when he had heard the news of a body being found on the 5th floor corridor of Plaza Masalam on 16 July 2009, he had gone to the alleged window to see the body and close the window.  Mohd Najeib explained that he had closed the window as he had not known that that was the window Teoh Beng Hock had allegedly fallen from.

The RCI-TBH proceeding was adjourned at 6:00 pm and will recommence at 9:00 am on Tuesday, 26 Apr 2011.

Allowing Truths To Prevail.

Thank you, Cheow Wee, for your hard work in the performance of your duty in the above regard; and your indulgence in the investigations thus far.

Beng Hock's spirit would be appreciative of your attempts at unravelling the truth of what had happened to him; and the whole nation would be grateful eventually to the Bar team - for all the truths revealed - which, sad to say, is also very much dependant upon the 'true conscience' of the witnesses who testified.

May all parties seek nothing but the truth; and allow the whole truths to prevail - that there might be 'justice' demonstrated eventually.
