KUALA LUMPUR: The Bar Council has condemned the circulation of a poster calling for the death of lawyer Malik Imtiaz Sarwar.
Malik had held a watching brief on behalf of the Malaysian Bar in the appeal case of Lina Joy.
Bar Council president Yeo Yang Poh said the poster was aimed at intimidating, threatening and oppressing a member of the Bar while discharging his role as a lawyer.
"Our justice system demands that parties be given the right to be heard. Hence, it is the duty of every advocate and solicitor to present and state his client’s case without fear or favour as it is under the protection of our courts that a lawyer is able to advance his client’s case, no matter how unpalatable his argument may appear to other parties."
Lina Joy or Azlina Jailani is appealing to the Federal Court to have the word "Islam" removed from her identity card as she is said to have embraced Christianity.
Describing the circulation of the poster as "shameful", Yeo said it was also an assault on the fundamentals of the nation’s justice system.
He called on the authorities to launch an immediate investigation to identify the parties responsible.
"Malaysian society must reach to show that there is no room for death threats or any similar acts of intimidation in our society."

It is a common mistake that they think that what they are doing is justified as it is Ijtihad in the name of the sanctity of Islam.
The Holy Quran however never prescribed the death penalty, as the matters concerning life and death of a person lies only in Allah swt hands and that Allah never delegated it to a human being to implement on Allahs behalf the death sentence.
"Surah 4:92 It belongs not to a Believer to kill a Believer except by mistake; and if any kills a Believer by mistake, then a Believing slave will be freed and blood-money paid to his family unless they forgo it as alms. And if he is from a people that is your enemy, while he is a Believer, then a Believing slave will be freed. And if he is from a people between whom and you is a covenant, then blood- money will be paid to his family and a Believing slave freed. And whoso does not find the means, let him fast for two successive months for a repentance from God; and God is Knowing, Wise."
"Surah Al Maidah:32 For that cause We decreed for the Children of Israel that whosoever killeth a human being for other than manslaughter or corruption in the earth, it shall be as if he had killed all mankind, and whoso saveth the life of one, it shall be as if he had saved the life of all mankind. Our messengers came unto them of old with clear proofs (of Allah's Sovereignty), but afterwards lo! many of them became prodigals in the earth."
"Surah Bani Israel: 33: Do not take life - which Allah has made sacred - except for just cause. And if anyone is slain wrongfully, we have given his heir authority (to demand qisas or to forgive): but let him not exceed bounds in the matter of taking life; for he is helped (by the Law)."
They cannot compel us all to believe what they believe.
"Surah Yunus :99-100 And if thy Lord willed, all who are in the earth would have believed together. Wouldst thou (Muhammad) compel men until they are believers?
It is not for a soul to believe except by Allah's permission; and Alalh casts uncleanness on those who do not use their aqal."
If I am not mistaken, the act of calling any Muslim a kafir is an offence in itself and is called Takfir, and is punished with the maximum sentence in the WP Syariah courts.

The learned commentator has been quite persuasive with her reply in relation to the death threats being a form of ijtihad.
Even so, I do not intend to propound arguments relating to the same as I am not schooled in the art of tafsir. By extension, please read the following with a liberal dose of salt.
I intend to confine this reply to that portion of the poster's comments in relation to Takfir (the practice of declaring an individual or a group previously considered to be Muslims as kafirs) to ensure that no misapprehensions arise from the same.
From the Quranic verse and even Prophetic Traditions (Hadiths), it seems to indicate that even at the height of the Islamic faith ie time of the Prophet, Takfir has been looked upon quite dimly.
This was so as the practice of declaring a Muslim a kafir was a violation of the rights of not only the individual but also a crime against society since it acts to severs the bonds of faith which ties the accused with the rest of society.
That said, this does NOT mean that those sources reveal the existence of an injunction against Takfir. In fact, the Quranic verses and Prophetic Traditions relating to Takfir merely emphasise that the GREATEST caution must be exercised before a Muslim is declared kafir.
All said and done, I do echo our President's calls for an investigation. However I do wonder, given that Malaysia is Malaysia, whether ultimately the investigation is going to reveal another conclusion as dramatic as Squat-gate. Except that this time the 'victim' is an agnostic/free thinker.
