PUTRAJAYA, Aug 10 (Bernama) -- The Prime Minister is the one who makes the ultimate decision on the appointment of the Chief Judge of Malaya, Chief Justice Tun Ahmad Fairuz Sheikh Abdul Halim said today.

Ahmad Fairuz said that under the Federal Constitution, the Prime Minister would consult the Chief Justice on the selection and the Yang di-Pertuan Agong, who would act on the advice of the Prime Minister, would consult the Conference of Rulers.

He, however, said consultation did not mean that it was binding on the Prime Minister to accept any candidate the Chief Justice picked.

"Consultation does not mean that you are bound by whatever views given," Ahmad Fairuz said after the swearing-in of eight judicial commissioners at the Conference Hall of the Palace of Justice here.

Zamani A. Rahim, 57, Vernon Ong, 51, Azman Abdullah, 46, Datuk Hinshawati Shariff, 52, Mohd Yazid Mustafa, 51, Zainal Azman Ab. Aziz, 50, Datuk Ahmadi Aznawi, 53, and Yew Jen Kie, 54, were sworn in before senior High Court Judge Datuk T.Selventhiranathan. Their appointments were effective from today.

With the latest appointments, there are now 36 judicial commissioners in the country.

When asked why the eight judicial commissioners were sworn in before a High Court judge, a departure from the previous occasion when the swearing-in was done before him (Ahmad Fairuz) acting as the Chief Judge of Malaya, the Chief Justice said the judiciary was only following the Federal Constitution, which was recently amended to allow for the appointments of judicial commissioners to be made before a senior High Court judge.

Ahmad Fairuz was also questioned on a newspaper report which claimed that the Conference of Rulers had rejected a candidate picked by the prime minister for the post of Chief Judge of Malaya, which has been vacant since January this year after the retirement of Justice Datuk Siti Norma Yaakob.

He said he did not know about the matter.

Ahmad Fairuz also denied that he had said that the appointment of Chief Judge of Malaya would be announced by the end of this month as reported by a newspaper.
