KUALA LUMPUR 22 Sept. - Ketua UMNO Bahagian Cheras, Senator Datuk Wira Syed Ali Alhabshee mencabar Majlis Peguam didaftarkan sebagai parti politik jika benar-benar mahu bermain politik dan mencampuri urusan pentadbiran negara.

Katanya, ini kerana sejak akhir-akhir ini majlis itu dilihat lebih cenderung kepada urusan permasalahan politik tanah air.

"Oleh sebab mereka nampaknya sudah menunjukkan minat bermain politik, maka saya syorkan mereka didaftarkan sebagai pertubuhan politik," katanya dalam kenyataan di sini hari ini.

Syed Ali berkata, tindakan majlis itu sejak kebelakangan ini yang amat ghairah mempertikai dan mempertahankan hak antara kaum yang berbeza menunjukkan majlis itu juga sudah dipengaruhi elemen politik kumpulan tertentu.

"Jadi jika Majlis Peguam boleh diperalat pihak tertentu untuk kepentingan politik, maka saya cabar mereka jadi pertubuhan politik dan menyertai pilihan raya umum akan datang," katanya.

Katanya, Majlis Peguam sepatutnya berfungsi sebagai pertubuhan profesional yang membela kepentingan kalangan peguam dan menjadi pemantau kepada perjalanan sistem perundangan di negara ini.

"Banyak isu yang boleh diperjuangkan oleh majlis itu dalam meningkatkan profesion guaman termasuk berusaha menangani ribuan kes yang masih tertunggak," katanya.

Syed Ali berkata, adalah lebih elok juga teguran dibuat secara berhemah dan sejajar dengan fungsi majlis itu sebagai badan profesional jika ia mendapati wujud kelemahan kerajaan ketika melaksanakan beberapa akta dalam undang-undang.

"Saya yakin kerajaan akan memberi layanan dan jawapan yang adil jika teguran dibuat dengan elok dan tidak ada unsur-unsur yang boleh dilihat sebagai permainan politik," katanya.

Siapa pula orang ini? Bercabar Majlis Peguam pula? Adakah locus standi kah? Tahu tak tahu apanya locus standi? Haiya, laporan Utusan Melayu?

My dear friend, although I do not know you, wait until you are elected as the MP for Cheras in your next life before you issue such a challenge.

The challenge is not even properly founded. Meanwhile, I am re-reading my favourite book about "Lee Kuan Yew's Singapore" by T.J.S. George who writes about the dogs barking and the caravan just moving on ...

Saya dah tak larat nak komen berkenaan dengan kenyataan-kenyataan yang dibuat oleh ahli-ahli politik yang tak ada modal, tak ada kredibiliti dan tak berintelek yang diberikan ruang untuk membodohkan diri di dalam akhbar yang mempunyai ciri-ciri yang serupa dengan mereka.

Kedangkalan minda ahli politik seperti Tuan Syed kita ini, res ipsa loquitor.

Obviuosly this Syed does not understand the role and function of our Bar Council. I really pity him to have such a blocked mindset. Anyone who does not agree or critical of the government's policies would be deemed as opposition. Come on, let us have our freedom to form our own opinion on a lot issues especially issues that deemed to be political.

As a body of all registered lawyers, would the government consider the bar's views seriously? No! I do not think so as the Bar Council does not have political clouds and the government is an elected one to have decided in whatsoever decisions. But cannot take crticism?

Asking the bar to stand for next election, it shows how idiotic can one be. But this was not the first time we have been hearing this, remember?

PUBLIC PERCEPTION

Please don't start hammering a man for voicing out his opinion. We as lawyers should respect the opinion of others, no matter how different they be from ours. We must be able to agree to disagree.

We should be mature enough to accept such statements especially when the Bar Council has been seen to be totally in sync with the stand made by political parties. Although we may claim to be completely independent, but when it comes to the crux, the public would notice that most of our walks or talks were with strong backing from political parties. Commonality of personalities. The public is not blind.

I accept brickbats from anyone of you lawyers who will readily call me an UMNO bigotist although I am NOT a member of UMNO. I remain non partisan, though I would readily and openly support Teresa Kok, Zulkifly Nordin, Lim Guan Eng, Takiyuddin Hassan for their brave stance. And I would readily condemn many many many UMNO and MIC members for the corruption and abuse of power.

Lets just imagine that the Malaysian Bar really registered as a political party. That would be very scary for some politician I guess. Anyone who need help from lawyers will then have to vote for our party. From conveyancing and litigations to criminals.

That is so ridiculous. Let's say a priest or an imam requested a politician not to take bribe, does not mean that the priest or imam must first register and become politician ? ...

My sister used to tell me when I am still young- "If you don't have anything smart to say, just keep quiet."

I ingat satu ke dua orang mereka yang berkeupayaan buat pernyataan-pernyataan otak kosong ... sekarang macam ramai (jika bukan semua) pun sama je ... sedihnya untuk negaraku ... tolonglah buat undang-undang untuk daftar masuk ahli-ahli politik yang mempunyai standard!!

Dear Nik Elin,

I can understand the perception of the general public against the Bar. The bias reporting by the media against the Bar (particularly the Malay mainstream media) is glaring. Especially the newspaper that carried this report. They are not at all interested in having a 'balanced' view of things. You may want to try to send your views on the right to disagree to them.

If we are dealing with the general public, I would be happy to explain issues of rights, the purpose of the Bar under the Legal Profession Act and why the Bar is always used as the scapegoat to deflect the issues that the current government cannot and do not want to deal with. The Bar has always been a convenient boogey man for the old trick of politics of 'diversion'.
I think Razlan and I have dealt with this at length in our letter to the Malay mainstream press that they did not see fit to publish.

About our Tuan Syed here, he is not the 'general public'. He is a politician and if it takes taking potshots against the Bar to be 'jaguh kampung' he will do it. Why not use his UMNO cawangan to organize a forum to discuss this issue. Invite speakers from various organizations to talk about the role of the Bar? They have the funds and opportunity to do so but do they? They rather take cheap pot shots at the Bar in newspapers that they have control in.

Further, how is it that the Bar is like a political party? The stand against ISA? Holding the recent forum that 'heroes' like Zulkifli Nordin saw fit to 'rempuh masuk' the Bar building to stop it? (Having said that, I have to disagree with you on the support you have for Zulkifli Nordin and the last thing I would call his antics during the forum is 'brave'). Are you not convinced that those are public interest issues which no one else wants to deal with? Should we then sweep it under the carpet and hope it goes away so as to remain 'politically' acceptable?

What then do you expect us to do? Applaud him for his views, smile and say ahh..you have your views and we have ours? Its about time we take a stand.

NOT A MERE OPINION, BUT A CHALLENGE

My dear Nik Elin

Long time no hear. With respect, we are not dealing with just an opinion. It is a challenge or cabaran in Bahasa.

And who is he to challenge the Malaysian Bar? Just another appointed Senator who has not even distinguished himself in the Senate. And reported by the Utusan Melayu, the same newspaper who reported on Teresa Kok and asked the MP to now take a lie detector test when such a test is known to be inconclusive.

I would have expected a Senator appointed to deal with great issues of state and not issue challenges which have no basis whatsoever.

We have previously dealt with a MP from Merbok who instead of singing like a nightingale hoots like an owl. The last I heard, he lost the election in Sungai Petani. Dia saya tahu. Namanya Zam.

Senator itu saya tak tahu. Let him show his ability by dealing with the great issues that affect our country, not throw challenges that betrays his grotesque inability to grasp what a statutory body such as the Malaysian Bar means.

And if he imagines himself to be so great, tell him to stand for election and not opt for appointments.
