KUALA LUMPUR: The High Court has reserved its decision on a leave application by
the five implicated in the Lingam video clip for a review of the findings of the
Royal Commission of Inquiry.
The application was filed in June by the five, who were
recommended to be investigated following the findings of the commission.
They are lawyer Datuk V.K. Lingam, tycoon Tan Sri Vincent Tan, former minister
in the Prime Minister's Department Datuk Seri Tengku Adnan Tengku Mansor and
retired chief justices Tun Ahmad Fairuz Sheikh Abdul Halim and Tun Mohd Eusoff
Chin.
Yesterday, senior federal counsel Azizah Nawawi said contrary to what was
submitted by one of the counsel, the attorney-general had the right to object
the application.
"The attorney-general is entitled to appear before the court during leave and
oppose the leave application."
At the end of Azizah's submission, counsel Razlan Hadri,
appearing as watching brief counsel for the Bar Council, applied for leave to
hand in written submissions on points of law relating to the Federal
Constitution.
Lingam objected to the application, stating that it was unfair for another party
(Razlan) to interfere at the last minute.
"The hearing began in July, and only now when this is about to finish that they
come to make an application."
High Court judge Datuk Abdul Kadir Musa allowed Razlan only to make submissions
orally through Azizah as he was not allowed to speak in open court.
The proceedings dragged on until 5.45pm, after all submissions were wrapped up.
The five had filed applications separately in June to quash the findings of the
royal commission, which recommended that they, together with former prime
minister Tun Dr Mahathir Mohamad, be investigated under the Prevention of
Corruption Act, the Sedition Act, the Legal Profession Act, the Official Secrets
Act and the Penal Code.
Lingam was implicated in the video clip which the commission said showed Lingam
in a conversation with Ahmad Fairuz over judicial appointments.
