Lawyer's suit against Malaysian Bar dismissed PDF Print E-mail

Malaysian BarKUALA LUMPUR, Fri: Justice Datuk Wan Afrah Wan Ibrahim today dismissed lawyer Ronnie Wong Chim Yiam's suit seeking an injunction to restrain the Malaysian Bar from allowing all those who were elected for the 2007/2008 term by a second team of scrutineers from taking or continuing in office.

In his originating summons, Wong has claimed that the appointment of Zain Azhari, M. Puravalen and Zainuddin Ismail as new scrutineers on Feb 23 was ultra vires the Legal Profession Act 1976.

The Malaysian Bar was represented by Lambert Rasa-Ratnam and Sean H M Yeow.

In December last year, the three original scrutineers – Datuk Dr Yaacob Merican, S. Radhakrishnan and Inderjit Singh – had nullified the elections and five days after that, lawyer Foo Ton Hin went to court seeking a declaration that the scrutineers had acted beyond their scope of duty.

Foo’s action was dismissed on Feb 15 and it is learnt that Yaacob is now claiming a sum of RM122,283.40, with the “getting up” for his striking out application and contesting Foo’s Originating Summons put at RM120,000 while the other defendants Boniface Lobo and Dr Rafie are both claiming RM43,694, with the getting portion of their bill put at RM40,000.
