KUALA LUMPUR: A lawyer is seeking a High Court declaration that a Malaysian Bar resolution on the videoclip that implicated lawyer Datuk V.K. Lingam was unconstitutional.

The resolution proposed by the Bar Council and passed by the Malaysian Bar at its extraordinary general meeting on Thursday called on the Royal Commission of Inquiry to look into the circumstances of the videoclip, to verify assertions made by the person in the video, and examine allegations made by Lingam’s brother in his two police reports.

Lian Meng Wah who filed his application for the declaration at the High Court yesterday also sought an order to set aside the purported adoption of the Bar Council motion as a Malaysian Bar resolution.

He claimed that the Bar Council’s power under the Legal Profession Act was limited to convening the meeting and circulating the motions proposed by members.
