GEORGE TOWN, PENANG, Mon.: The magistrate’s court will decide on Feb 15 if a lawyer charged with using insulting words against a traffic policeman should be called to enter his defence.
Magistrate Fatimah Rubi’ah Ali fixed the date after hearing submissions from R.S.N. Rayer’s lawyer, Jagdeep Singh Deo, and deputy public prosecutor Abdul Razak Musa.
Rayer was alleged to have said "Hoi, pekak ka (are you deaf)?" to a traffic policeman in front of a florist’s shop on Lebuh Pitt here on July 5, 2003.
The offence under the Minor Offences Act carries a maximum RM100 fine.
Jagdeep submitted the prosecution had failed to prove its case as there was no evidence that the words had been uttered in an insulting manner.
Razak said the prosecution had proven its case against Rayer by adducing evidence to show that he had uttered the words in an insulting manner.
He said the traffic policeman was only doing his duty when he issued a summons to Rayer for parking in a no-parking zone.
