PETALING JAYA:
Former Bukit Bintang MP Wee Choo Keong is seeking about RM40mil in damages from MBf Holdings Bhd and AmBank (M) Bhd for wrongfully obtaining an ex-parte injunction in 1993 to stop him from making allegations on financial irregularities about the companies and its officers.

Wee filed an affidavit at the High Court registry (civil) on Tuesday for the court to assess his damages.

Among others, Wee is claiming RM4mil for the pain, mental distress and mental agony he suffered during the period and RM5mil for the suffering and agony due to his disqualification as an MP in 1995. 

He is also seeking RM5mil for loss of political standing after being disqualified as MP and RM6mil for loss of professional standing as a lawyer.

When contacted, Wee said: “I want a fair assessment of damages because on Aug 2, 1995, I was disqualified by the election judge to stand for the general election as a result of the ex-parte injunction.”

On June 20, Wee’s legal saga with two MBf companies was finally settled after 14 years when the Kuala Lumpur High Court struck out the companies’ suit against him and two others.

The court also ordered the change of the names of the two MBf companies as plaintiffs to AmBank (M) Bhd and ordered it to pay incidental costs, too.

The saga started in 1993 when MBf Holdings Bhd and MBf Finance Bhd filed a suit to restrain Wee, MBf Holdings Bhd group chief accountant Houng Hai Kong and former MBf Finance group EDP manager Loi Hean So from printing, circulating or publishing any allegation of impropriety about the companies.

On Jan 28, 1994, the plaintiffs succeeded in committing Wee to prison for two years for the alleged breach of an ex-parte injunction and another two years for evasion of service of the said ex-parte injunction.

Wee appealed to the then Supreme Court and on April 14, 1995, the court allowed the appeal of the ex-parte injunction and set aside the jail sentence and replaced it with a fine.

On April 12 this year, the Court of Appeal allowed Wee and Houng’s appeal to set aside the ex-parte injunction.
