Tan Sri Khalid Ahmad Sulaiman says the complaint is not special KUALA LUMPUR: The legal profession's disciplinary board said a complaint by the Bar Council against lawyer Datuk V.K. Lingam for alleged professional misconduct would take its normal course. "We are treating it like any other complaint made by the council against lawyers," board chairman Tan Sri Khalid Ahmad Sulaiman said after chairing its monthly meeting yesterday. Khalid was referring to the complaint lodged on Sept 24 in connection with a video clip allegedly depicting Lingam in conversation over judicial appointments with a senior judge. It is learnt that the complaint was discussed at the meeting. Procedurally, the board would study each complaint and decide whether to pursue the case. If there is merit in the complaint, the respondent would be given 14 days to explain. After studying the reply, the board would decide whether or not to set up a three-man panel to formally investigate the complaint. Those found guilty of misconduct under Section 103 of the Legal Profession Act 1976 could be fined, suspended, reprimanded or struck off the rolls. The respondent can appeal to the High Court against the board's decision. Comments (1)

Mr Chairman
I do not hold myself out as a know-all but, for goodness' sake, let us ensure that the steps taken are right and correct this time.
We at the Malaysian Bar cannot afford another foul-up on the grounds that the basic Rules of Natural Justice were infringed. I remember that such a foul-up occurred in an earlier case when photographs of a Chief Justice on holiday with a lawyer were freely available in cyber space.
The case was dismissed, if my memory serves me right, because some people who ought not to sit, did sit in the Disciplinary Board meeting that decided to constitute the Investigating Tribunal. (http://www.malaysianbar.org.my...w/4296/27/)
