PETALING JAYA (March 5, 2007): The Bar Council election fiasco is anticipated to be a hot topic for discussion at its annual general meeting on March 17.

Lawyer M. Kulasegaran said the forged ballots issue, which had caused the body much embarrassment, would certainly be raised.

He said while a lot of criticisms and recommendations would be forwarded to the present office-bearers over the handling of the issue, members would also want the issue to be put to rest.

"They would want a fool-proof system to be set up to prevent a recurrence of such incidents," said Kulasegaran.

The issue of forged ballot papers which was detected by three scrutineers threw the Bar elections into disarray as the matter was dragged to court by its own members.

The initiation of a probe following a police report also resulted in many members feeling the council was incapable of solving its problems internally.

Kulasegaran said that the dissatisfaction among members over the amendments to the Legal Profession Act was also expected to be raised again.

The council, he said, had to work more closely with the government (Attorney-General's Chambers) to ensure further amendments to the LPA were done after thorough and transparent consultations.

Another lawyer, Akbardin Abdul Kader, said the appointment of new scrutineers following the disruption to the council's 2007/2008 term was expected to be brought up.

He said members would question the council's decision in replacing the previous scrutineers which implied that it did not respect their decision.

The council, last week, appointed three new scrutineers to carry out a recount of the ballot papers in front of the police, after which the results were announced.

Lawyer Datuk Bastian Pius Vendargon also said the forged ballot issue was expected to be the "hottest" subject at the AGM.

He said that the appointment of the new scrutineers and the outcome of the results following a recount of the ballots would be raised at the meeting.

"Members will question the council whether its actions, which later developed into a court case, was morally, ethically and legally correct," said Vendargon.

The discussions on amendments to the LPA, he said, was again expected to crop up as many members were unhappy with the manner in which the committee set up to handle the proposed changes did its work.

"The council cannot satisfy everyone, but it should aim to satisfy the majority of its members," added Vendargon.

Lawyer D.P.Vijandran said instead of getting involved in "skirmishes" with the office-bearers, members should work towards putting the past behind them and find solutions to the problems which had affected the council's integrity.
