Bar defends its judicial commission proposal PDF Print E-mail

ImageThe Bar Council today defended its proposal for an independent judicial services commission to handle future appointments of judges in the wake of Prime Minister Datuk Seri Dr Mahathir Mohamad’s statement that the inception of such a commission might leave judges feeling indebted to the Bar.

Bar Council chairperson Kuthubul Zaman Bukhari was quoted by Malaysiakini today to have said the Prime Minister's fear was "misplaced" and Dr Mahathir’s logic that judges were indebted to those who appointed them had also implied that the current crop of judges would now be "afraid" of or indebted to the chief justice and the prime minister, both of whom play a major role in their appointments.

Malaysiakini also reported Khutubul's statement that an increasing number of Commonwealth countries were adopting the idea to ensure greater transparency in the appointment and promotion of judges, and that the judicial commission proposal was made in the belief that it could only enhance the independence of the judiciary in the interest of the country.
