11-year wait worth it, says Bar Council PDF Print E-mail

Ragunath KesavanKUALA LUMPUR: It was worth the 11-year wait, and now the Bar Council feels vindicated.

The council had voiced its protest on the legality of the three-man Federal Court bench which heard the Ayer Molek case in 1995.

Council secretary Ragunath Kesavan said they always felt that the validity of the three-man bench was questionable.

"That was our stand 11 years ago and we feel the same today," Ragunath said. "Finally, the High Court has come in support of the stand taken by the Bar."

"As far as the council is concerned, the Ayer Molek decision was one of a series of cases where the independence of the judiciary was questioned."

He said the decision by the then Appeal Court judge Datuk N.H. Chan was welcomed as the council felt the judiciary was finally making a strong stand against what had been perceived as "a judiciary which is not independent and transparent."

"We believe the judiciary should not only be independent, but must be seen to be independent."
