Contributed by Chin Oy Sim, Deputy CEO, Bar Council26 candidates have filed nomination papers for election to the Bar Council for the 2011/2012 term, pursuant to section 49 of the Legal Profession Act 1976. This represents a decrease from last year’s pool of 32 candidates and a departure from the number of contenders in the previous five years, which has generally surpassed 30. Two current Bar Council members who were elected during last November’s election process – Cecil Rajendra and Edmund Bon Tai Soon – are not seeking re-election for the upcoming term. Members should receive their ballot papers by post beginning 8 Nov 2010 and may vote for a maximum of 12 candidates. The last day for the return of the postal ballots is Tuesday, 30 Nov 2010. The ballots will be delivered to the scrutineers on 1 Dec 2010 and the results will most likely be declared on the same day. The term of the 2010/2011 Bar Council members will expire at the next Annual General Meeting, scheduled for Saturday, 12 Mar 2011. Pursuant to the Resolution passed at the AGM held on 17 Mar 2001, below are the brief (unedited) write-ups of the candidates standing for election. HJ. ABDUL MURAD B. CHE CHIKPrincipal Partner of Messrs Zain Megat & Murad. Hj. Abdul Murad commence career with the Royal Malaysia Police (PDRM) in 1973 as an Inspector. He served as Staff Officer in Bukit Aman for 11 years with another 7 years as Lecturer/Directing Staff of Senior Officers Training College. In 1989 he was granted study leave to read law at the International Islamic University (IIUM) and graduated with a Bachelor of Laws (Hons) in 1993. After graduation he was a Prosecutor at the Kuala Lumpur Magistrates and Sessions Criminal Court. He then continued to pursue a Masters of Comparative Laws (MCL) degree at IIUM and upon graduation in 1995 enrolled for a post-graduate Diploma in Shariah Law & Practice. In 1995, he took early retirement from PDRM to commence legal practice after being admitted as Advocate & Solicitor on 25 October, 1995. Hj. Abdul Murad served as member of the Bar Council’s Conveyancing Practice Committee from 2007 to 2010 and member of the Solicitors Remuneration Order Enforcement Committee (SROEC) from 2006 to 2010. In 2009 he was appointed as Deputy Chairperson of SROEC was also elected as Chairperson of the Selangor Bar, Conveyancing Practice Committee. Currently, Hj. Abdul Murad is the Chairman of the Bar Council’s Conveyancing Practice Committee and also a member representing Bar Council in the Legal Profession Qualifying Board Malaysia for BM Qualifying Test. Proposers: Cheong Yoke Ping Bernard Kok Yin Fook A. Ramanathan ABDUL RAHIM BIN SINWANLLB (Hons), MCL.DSLP Abdul Rahim Sinwan graduated from the International Islamic University Malaysia (IIUM) in 1989. Abdul Rahim Sinwan was called to the Malaysian Bar in March 1991. He lectured at the IIUM from 1991 to 1994 and proceeded with his legal practice thereafter. To date he has represented clients in many cases including Landmark constitutional cases. As a committed member of the Malaysian Bar, Abdul Rahim Sinwan acted for the Malaysian Bar as complainants’ counsel in the Disciplinary Board from 2008. He also served the Malaysian Bar Syariah Law Committee in 2008/2009.and 2009/2010.He was the Co-Director SLC Conference Islamic Finance 2010. Abdul Rahim Sinwan’s vision is to uphold the principle of law and justice in serving all members without fear or favour. Abdul Rahim Sinwan is also an avid sportsman. He represented Malaysian Bar in Premier Soccer in the early 1990’s. Currently he is a mountaineer conquering mountains in Malaysia and South East Asia. Proposers: Nazira bt Abd Rahim Harfizah bt Abdul Ghaffar Habib Rahman bin Seeni Mohideen AISHA MUBARAKAisha Mubarak was introduced to me by a dear friend, the late Datuk M. Sivalingam, who was Aisha’s God-Father and Mentor. She had in 2004 just left her job as lecturer at the Faculty of Law UiTM and had decided to enter practice after spending nearly 4 years teaching Constitutional Law in the University. Aisha started her own firm as a Sole-Proprietor in Putrajaya in 2005. She was the first lawyer to set-up practice in Putrajaya. She then teamed with her present partners to form Messrs Hafarizam Wan & Aisha Mubarak. Aisha is a very personable and capable person. It is thus, with great pleasure that I am proposing this dynamic young lady to the Bar Council. I trust she will inject some much needed new wave and ideas to move our Bar forward in these changing times. Proposed & Introduced by P K Nathan, JB Proposers: PK Nathan Dato’ Bastian Pius Vendargon Murad Ali bin Abdullah AMIR BAHARILLB (Hons) IIUM, MCL(IIUM), DSLP(IIUM), LUTC(MII), IFP(FPAM), CPT (MIM), AMIM, MCT (BKI) Advocates & Solicitors, Syarie Counsel Amir Bahari graduated from the International Islamic University Malaysia (IIUM) in 1997. He read law under the great luminaries of IIUM notably Tan Sri Prof. Ahmad Ibrahim, Tan Sri Harun Hashim, Tan Sri Wan Hamzah and Datuk Nik Abdul Rashid. Amir was called to the Malaysian Bar in 1998. As a committed member of the Malaysian Bar, Amir has also served the Bar Council Syariah Law Committee in the year 2006/2007, 2008/2009 and 2009/2010, Bar Council Mediation Committee 2009/2010, Malaysian Bar Law Conference 2010 and Selangor Bar Syariah and Bahasa Malaysia Committee. Currently Amir is a partner in Messrs Bahari & Bahari focusing in the area of Islamic Will Writing and Estate Administration. Amir currently serves as the Assistant Secretary General of the Malaysia Legacy Management Association (PERWARIS) and was tasked to design and coordinate curriculum for Islamic Financial Planners in providing ethical and comprehensive estate planning services. Amir has committed to give talks at the Selangor Bar and KL Bar in the area of Islamic Will in the month of November / December 2010. Amir has also written series of articles to Mingguan Wanita, Millennia Muslim and Personal Money in the area of Syariah based Estate Planning. Justice begets Equality Proposers: Mohd Rifahmi Abdul Musikin Wan Nur Ehsaniah W Mamat Saufi Mohd Rizal Bahari ANAND PONNUDURAII nominate Anand Ponnudurai for election to the Bar Council for the 2011-2012 term. I have known Anand for many years and do sincerely commend him to you. He was admitted and enrolled as an advocate and solicitor of the High Court of Malaya in 1991 and has been in active practice for 19 years. In his time at the Bar, Anand has consistently lent his support and participation in numerous activities of the Malaysian Bar. He has also contributed his talents in acting as counsel for the Malaysian Bar in several cases, and served on the Investigating Tribunal and Disciplinary Committee of the Disciplinary Board. Anand has additionally given his time and energies to the Kuala Lumpur Bar by serving on the Kuala Lumpur Bar Committee (“KLBC”) since 2004. He was elected as a committee member of KLBC from 2004 to 2009, and was its Honorary Secretary for 2007-2008. Anand was subsequently elected the Chairman of the Kuala Lumpur Bar in 2009, and is currently serving in that position. In the 2 years that he has served on the Bar Council, he has been the Chairman of its Industrial Law Committee, Deputy Chairman of its Sports Committee, and acts as one of the Chairpersons of the Compensation Fund Adjudication Panel. In addition, Anand has taken active participation in discussions at meetings of the Bar Council. I am confident that Anand will continue to serve the Malaysian Bar well if elected to the Bar Council for the 2011-2012 term. Christopher Leong Proposers: Ragunath Kesavan Ambiga Sreenevasan Christopher Leong ANDREW KHOO CHIN HOCKAndrew Khoo Chin Hock currently serves as Chair of the Human Rights Committee (HRC) and Deputy Chair of the Trade in Legal Services Committee (TLSC). He also serves on the Legal Profession Committee (LPC), the Islamic Finance Committee (IFC), the Committee on Orang Asli Rights (COAR) and the Sub-Committee on Migrants, Refugees and Immigration Affairs (SMRIA). Through the HRC, COAR and SMRIA, he promotes and highlights the Bar’s position on human rights issues. These include repealing the ISA, caning and the death penalty; strengthening data protection, privacy, freedom of assembly, expression and information, religious freedom; advocating fair and just treatment for women, children, persons with disabilities, indigenous peoples, migrants, refugees, asylum-seekers and minorities; ending human trafficking; and monitoring rallies. For both LPC and TLSC, Andrew is on the joint Attorney-General’s Chambers-Bar committee which is drafting amendments to the LPA and creating rules for the establishment, licensing and regulation of international partnerships and registration of foreign lawyers. He is also the Bar’s Alternate Member on the Professional Services Development Corporation’s Advisory Panel. For the IFC, Andrew has worked to help organise and implement various symposia on Islamic Finance during the last term. Andrew led the Bar watching brief team at the SUHAKAM public inquiry into the arrest on 7 May 2009 of five lawyers outside the Brickfields Police Station in Kuala Lumpur. He is also involved in the steering committee of BERSIH 2.0 and with efforts to re-introduce local government elections. Outside of legal practice Andrew serves as co-Coordinator for the partnership between the Anglican Diocese of West Malaysia and the Anglican Province of Myanmar. Since May 2008 he has coordinated relief and rehabilitation assistance by the Anglican Church in West Malaysia to the Anglican Church in Myanmar for the victims of Cyclone Nargis in Myanmar’s Delta region. This has now been expanded to cover those affected under Cyclone Giri, which recently hit western Myanmar. Andrew was called to the Bar of England and Wales by the Honourable Society of Gray’s Inn in November 1991. He was subsequently admitted as an Advocate and Solicitor of the High Court of Malaya in May 1995. He has been a member of the Bar Council since March 2009. Proposers: Syamsuriatina Ishak Christopher Leong George Varughese CHRISTOPHER LEONGIt is with pleasure that I nominate Christopher Leong for election as member on the Bar Council for 2011/2012. Christopher Leong has served the Malaysian Bar with dedication and diligence for many years and in various capacities. He is currently serving as a member of the Bar Council for 2010/2011. In addition to his contribution in getting work done, his input to debates and discussions at council meetings have been valuable and insightful. He has represented and defended the Malaysian Bar in various cases, including at the Royal Commission of Enquiry into the infamous videoclip depicting a person alleged to be a lawyer speaking on the phone about judicial appointments. In addition to the above, his past activities include the following: 1. Member of the Bar Council, March 2004 –2010 2. Chairman of Organising Committee for the 21st LAWASIA Conference Christopher Leong has done invaluable work for the Malaysian Bar and has been most effective in everything he has undertaken. Datuk Kuthubul Zaman Bukhari Proposers: Datuk Kuthubul Zaman Bukhari Hendon Mohamed Ira Biswas GEORGE VARUGHESEIt is with pleasure that we propose George Varughese as a candidate for election to the Bar Council for 2011/2012. In March 2010 George was re-elected Hon. Secretary of the Bar Council and has continued to work diligently in ensuring that the Secretariat functions professionally so that the welfare and needs of members are attended to efficiently. George also serves as the Chair of the Trade in Legal Services (TiLS) Committee and as Deputy Chair of the Finance Committee. George can be described as modest and unassuming. He is firm in his beliefs yet open to discussion, and more importantly honest and prepared to put in the hours required to carry out his responsibilities effectively. He has also in the past contributed his energy and time to the Bar in various other capacities as detailed below:-

Proposers: Haji Sulaiman Abdullah Yeo Yang Poh Tommy Thomas HENDON MOHAMEDThis candidate hopes, if elected, to be able to continue to serve The Bar in any way she still can. Petra Oon, 30 October 2010 Proposers: Christopher Leong Andrew Khoo Petra Oon HONEY TAN LAY EANHoney was called to the Malaysian Bar in 1990. She has a LLB from University of Buckingham, LLM from Warwick University, and was called to English Bar (Middle Temple) in 1989. She left the Penang Bar in 2003 and now practices in Kuala Lumpur. In 2010, Honey organised and moderated 2 talks in the area of Family Law for the Selangor Bar, and moderated the session ‘Child Custody: Assessing the Assessors’ at the recent 15th Malaysian Law Conference. She chairs the Enforcement of Maintenance Sub-Committee of the Family Committee. Serving as a member of the Professions Standards and Development Committee, she is now in the midst of organising seminars on sexual harassment at the workplace, and on the conduct of judicial review in court. Honey is also involved in developing the law and standards on equality and non-discrimination. She is lead counsel for a few women’s groups holding a watching brief in a case involving the archaic law under S498 of the Penal Code, and is part of a team that is challenging the decision of a public authority to not engage the services of a teacher as a result of her pregnancy. She is also acting pro bono for a child who is facing charges as a result of the mass arrests in the 2009 anti-ISA rally. Honey is one of the writers producing the first women’s rights report for Malaysia in a project funded by the European Commission. Recently, she gave a talk at the Institute Latihan Kehakiman dan Perundangan (ILKAP) on the Federal Court decision of Beatrice Fernandez and whether it undermined the principles in the UN Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). Proposers: Petra Oon Beng Ai Amer Hamzah Arshad Pushpa Ratnam ISMAIL ARIFINIsmail Arifin holds an LL.B Hons Degree and a Diploma of Syariah and Legal Practice from the International Islamic University Malaysia. Ismail was called to the Malaysian Bar in 1997. With such strong passion of becoming Malaysia’s renowned litigator, Ismail has adapted and thrives in complex litigation proceedings. His involvements in many legal proceedings of public listed companies have provided him with the invaluable knowledge and experience needed to be a renown corporate litigator. His meticulousness, strong analytical skills and sharp legal acumen have won him great respect and confidence from his clients and adversaries alike. Ismail is currently focusing on Construction Dispute matters while pursuing a Certificate in the 15th Entry Level Course to qualify him as an Arbitrator. Upon completion, Ismail shall have access to unlimited possibilities of solving construction disputes as a Chartered Arbitrator. Ismail is a firm believer in Merit Over Technicality Proposers: Mohd Amir Sharil Bahari Wan Nur Ehsaniah W Mamat Saufi Mohd Rifahmi Abdul Musikin JAHABERDEEN @ JABARI have known Jahaberdeen (also known as Jabar or Jahamy to his friends) for more than 10 years. He obtained his Economic’s Bachelor’s Degree from Universiti Kebangsaan Malaysia. After graduation, he was supervising and taught economics at Stamford College. Subsequently he read law at the University of Leeds and did his pupilage in the chambers of Datuk Seri Muhammad Shafee bin Abdullah. He subsequently obtained his Master in Comparative Laws from International Islamic University of Malaysia. Currently he practices under the style of “Jahaberdeen & Co”. He has been a member of the Human Rights and Syariah Law Committees for some years. He has published a book on economics for Form Five student, “ Islam: Antara Isi Dan Kulit” in 2006 and “Rapera” recently. He had chaired several Disciplinary inquiries. He also acts as honorary lawyer and legal adviser for several NGOs and charitable organizations. He is active in several NGOs, such as JUST International. I have known him to be active in advancing several social and national issues including delivering talks on comparative religion and Islam and also social justice and public forums in several local universities. In recognition of his social contributions to the youth in Penang, he was awarded the ‘Pingat Jasa Masyarakat’ by the Governor of Penang in year 2007. Proposers: Tommy Thomas Ragunath Kesavan Lim Chee Wee LOW BENG CHOOI have known Beng Choo for more than 30 years, as university coursemate and a former partner. Having graduated with LLB (Hons) from University of Malaya in 1982, Beng Choo did her pupilage with Messrs Ariffin & Partners. She subsequently obtained her Masters of Science in Information and Technology from the University of Staffordshire, United Kingdom in 2002. She is now a consultant with Messrs Ranjit, Ooi and Robert Low. I remembered distinctly, when we were colleagues, the umpteenth occasions when she would unselfishly and unhesitatingly make time to meet pupils who have completed their pupilage and who have called upon her to move their calls. Beng Choo was elected to the Bar Council 1996/1997 and has been elected annually from the floor since then. She was formerly Chair of the Conveyancing Practice Committee, Court Liaison Committee, Cultural and Charity Committee and the Law Reform and New Legislation Committee. She continues to serve on the Conveyancing Practice Committee as Deputy Chair. I have known her to be active in sports during our university days and this has not abated. She was appointed the Chef-de Mission for the Sea Games held in the Philippines in 2005 where she successfully led the Malaysian contingent to surpass the target set. She serves as a vice-president of the Olympic Council of Malaysia, a post she has held since 2002. I believe, with her vast experience, Beng Choo, if elected will continue to be a voice to be heard as she never hesitates to speak up without fear or favour when it is required and will be able to contribute positively and effectively to the Malaysian Bar. Written by : Lee Poh Kwee Proposers: Lee Poh Kwee Jessentha Siluvaimuthu Steven Wong Chin Fung P. SUPPIAH1. Mr Suppiah was called to the English Bar in 1959. Admitted as an Advocate and Solicitor to the Singapore Bar in 1960, Malaysian Bar in 1961. He is a very senior member of the Bar. Since then, he has been in active practice in Johore Bahru (except for five years – 1964 to 1969 – when he was a Legal Officer in the Malaysian Armed Forces holding the rank of Major). He was a Judge Advocate of the Malaysian Armed Forces for a while thereafter. 2 He was on the Bar Council in 1972, 1982 and 2003 to 2005 as Johore’s representative. 3. He has written a book on “Military Law”. He has about 52 reported cases in the Law Journals – civil as well as criminal. 4. He has been connected with football and golf. Still plays golf. 5. He has also written a book on “Football Rules”. 6. He is the current Chairman of the Johore Bar. Philip Nainan (Date: 21.10.10) Proposers: Philip Nainan Feruz Anwar Seth Nurul ’Akhmar Mohd Shafiee RAO SURYANARao Suryana graduated from the International Islamic University Malaysia (IIUM) in 1997. Currently she is a legal practitioner and also a part time lecturer at her alma matter. Rao was called to the Malaysian Bar in 1998. As a committed member of the Malaysian Bar, Rao has also served the following positions: • Secretary to the Bar Council Syariah Law Committee in the year 2009/2011 • Sub committee, Professional Indemnity, Bar Council Malaysia 2009/2011 • Honarary Secretary, Kedah/ Perlis Bar Committee 2009/2011 Roa also actively participated in various Bar Council events from ladies soccer in 1998 to speaking at national young lawyers roadshow in 2003. Known as a fiery yet firm speaker and with a never-say-die attitude, Rao has won many admirers for her fresh perspective in issues relating to Sole Proprietors. Different. Driven. Determined Proposers: Mohd Amir Sharil Bahari Wan Nur Ehsaniah W Mamat Saufi Mohd Rifahmi Abdul Musikin RAPHAEL TAY CHOON TIENRaphael Tay was admitted and enrolled as an advocate and solicitor of the High Court of Malaya in 1986 and has been in active and continuous practice since then. He is also a notary public. He believes passionately that learning is a lifelong activity. It never ceases regardless of age or seniority and is his firm belief that continuing professional development is an integral part of professional life. With this same passion he serves on the Professional Standards and Development Committee of the Bar Council. He is also a panel member of the Investigating Tribunal of the Disciplinary Board and is the current Chairman of the LAWASIA Moot Standing Committee. He also lectures pupils reading in chambers on behalf of the Bar Council and Ethics Committee. Raphael is also the Deputy Chairman of the 15th Malaysian Law Conference. Raphael was a recipient of the Tun Hussein Onn Renewal Award (THORA) in 2004. An award jointly sponsored by The Malaysian Institute of Management and Konrad Adenauer Foundation of Germany. Raphael would like to give back to the Malaysian Bar what the Bar has unreservedly given him all these years. His will be a strong voice of reason and he will be undoubtedly an asset to us on the Council. Proposers: Edmund Bon Tai Soon Hendon Mohamed Nahendran Navaratnam RICHARD WEE THIAM SENGRichard Wee has served the Bar for years, both at the Bar Council and the Kuala Lumpur Bar Committee level. He has served the Kuala Lumpur Bar Committee from 2005 to 2010, where he has chaired the Young Lawyer’s Committee, the Pupil’s Welfare Committee and Information Technology Committee. From 2009 to 2010, he served as the Honarary Secretary of the Kuala Lumpur Bar Committee. Richard has also served the National Young Lawyer’s Committee for a number of years from 2006 and is still a member of the Committee. He was the Deputy Chairperson of the National Young Lawyers Committee from 2006 to 2007. Richard is committed to human rights and proof of this is in his involvement with the Human Rights Committee, where he is a member from 2008 to 2010. He was a member of the Organising Committee for the Malaysian Law Conference in 2005 and 2007. In 2007, he was also a member of the Organising Committee for the LAWASIA Conference. He has also represented the Bar in various matters, including the ongoing Teoh Beng Hock Inquest proceedings and at the Royal Commission of Inquest investigating issues of Police Powers for Bodily Search. Currently, he heads the Bar Council’s efforts to create awareness of Section 28A of the Criminal Procedure Code to ensure that members of the public know their right to legal representation. The breadth of Richard’s experience will no doubt contribute greatly to the Bar Council. He is a fierce advocate of the values of the Bar and he is passionate about serving the Bar. Haji Sulaiman Abdullah, 28/x/2010 Proposers: Haji Sulaiman Abdullah Syahredzan Bin Johan Lai Chee Hoe DATO’ HJH SHAMSURIAH BT SULAIMANLLB (Hons) Malaya, SPIL-Malaya, DSLP-UIAM; Advocate & Solicitor; Peguam Syarie; Mediator (Australia-Bar Council) She was a former Perak Bar Chairman (2002-2004). Currently serves as the Perak Bar representative and the Co-Chairperson of the Syariah Laws Committee of the Bar Council. She has untirelesly served the Malaysian Bar and the Bar Council for a continuous period of 14 years in the Syariah, Environmental, Mediaton and Islamic Finance Committees. She has also served the Perak Bar Committee for 12 years. She has faced and withstood the challenges in the promotion improvement and betterment of the working environment and administration of justice for legal practitioners and the public both in the Civil and Syariah fields. With her continuous zeal and to serve (and strife), she would be a great asset to the Malaysian Bar. He was admitted to the English Bar at Middle Temple in 1991 and the High Court of Malaya in 1992. He holds a Masters in Laws degree from the University of Malaya. He is currently a litigation partner of Messrs Shook Lin & Bok. Steven has served the Bar for many years. We began together in the late 1990’s in the Human Rights Committee and we both served in the Continuing Legal Education and the Professional Standards and Development Committee. We share a passion for improving the quality of legal education for law students, pupils and practitioners. Steven was the Chairman of the Kuala Lumpur Bar Continuing Legal Education Committee (two terms) and later the Chairman of the Professional Standards and Development Committee of the Bar Council (also for two terms). He recently chaired the Bar Council’s Ad-Hoc Committee on the Common Bar Course (CBC), which drafted the Bar Council’s CBC scheme. He has now served as a member of the Bar Council for three terms. Steven is currently a member of the Bar Council (2010/2011), the Deputy Chair of the Committee on Orang Asli Rights, a Committee member of the Industrial Law Committee, a Committee member of the Lawasia Sub-committee on Labour Law and a Council member of the London based Commonwealth Lawyers Association. I have had the privilege of working with Steven in a number of cases. He is a dedicated and conscientious advocate. He continues to combine his active civil litigation practice with public interest and minority rights cases. We were part of the team of lawyers in the recently concluded landmark Orang Asli land rights case of Sagong Tasi, which was undertaken on a pro-bono basis. I have had the pleasure of appearing with Tina in Court and have found her a courteous, knowledgeable and well-prepared lawyer of integrity at all times Tina was voted-in as a Bar Council member for the 2010/2011 term and showed an excellent track record for tireless service to members. She chaired the Publications portfolio, which has recently secured a collaboration contract with LexisNexis to revive the Praxis at minimal cost to the Bar, with its publication recommencing in January 2011. Tina is also known as a committed member of the Human Rights Committee and is often an active and useful participant in dialogues concerning matters of law reform and Human Rights. Tina also tirelessly served as the Honourary Secretary of the Selangor Bar in 2009/2010. Many new members of Council often take time to find their bearings before they actually begin to contribute meaningfully to the deliberations of Council. She has been actively involved in NGO work relating to women and children for the past 23 years. She assisted in the drafting and lobbying for the Domestic Violence Act . She is very passionate about the issue of Juveniles and is currently working towards revamping the Malaysian Juvenile Justice System by introducing alternatives to custody such as Mediation , Family Conferencing and other suitable / tailor made solutions.
