Dato’ Yasmeen Shariff (Kuala Lumpur & Kedah / Perlis) Since 2008, the number of candidates has ranged from 23 to 26, a departure from earlier years when the pool of contenders generally exceeded 30. All Bar Council members who were elected during last November’s election process are seeking re-election for the upcoming term. However, Ragunath Kesavan, the immediate past President, is not. The new faces are Brendan Navin Siva, Jude C. Raj, Dato’ Manpal Singh Sacdec (Steve), Roger Chan Weng Keng, Syahredzan Johan and Tan Peek Guat. Close to 14,000 Members of the Bar are eligible to cast their votes in this election. Members should receive their ballot papers by post beginning 8 Nov 2011, and may vote for a maximum of 12 candidates. The last day for the return of the postal ballots is Wednesday, 30 Nov 2011. The ballots will be delivered to the scrutineers on 1 Dec 2011 and the results will most likely be declared on the same day. The term of the 2011/2012 Bar Council members will expire at the next Annual General Meeting, scheduled for Saturday, 10 Mar 2012. Pursuant to the Resolution passed at the AGM held on 17 Mar 2001, below are the brief (unedited) write-ups of the candidates standing for election. (1) ANAND PONNUDURAIIt is my pleasure to nominate Anand Ponnudurai for election to the Bar Council for the 2012-2013 term. I have known Anand for many years and do sincerely commend him to you. He was admitted and enrolled as an advocate and solicitor of the High Court of Malaya in 1991 and has been in active practice for 20 years. In his time at the Bar, Anand has consistently lent his support and participation in numerous activities of the Malaysian Bar. He has also contributed his talents in acting as counsel for the Malaysian Bar in several cases, and served on the Investigating Tribunal and Disciplinary Committee of the Disciplinary Board. Anand has additionally given his time and energies to the Kuala Lumpur Bar by serving on the Kuala Lumpur Bar Committee (“KLBC”) since 2004. He was elected as a committee member of KLBC from 2004 to 2009, and was its Honorary Secretary for 2007-2008. Anand was subsequently elected the Chairman of the Kuala Lumpur Bar in 2009. In the 3 years that he has served on the Bar Council, he has been the Chairman of its Industrial Law Committee, is currently Co- Chairman of its Sports Committee, and acts as one of the Chairpersons of the Compensation Fund Adjudication Panel. In addition, Anand has taken active participation in discussions at meetings of the Bar Council. I am confident that Anand will continue to serve the Malaysian Bar well if elected to the Bar Council for the 2012-2013 term. Christopher Leong Proposers : Christopher Leong Ragunath Kesavan Adlan Hadi (2) ANDREW KHOO CHIN HOCKAndrew Khoo Chin Hock currently serves as Chair of the Human Rights Committee (HRC) and Deputy Chair of the Trade in Legal Services Committee (TiLSC). He also serves on the Legal Profession Committee (LPC), the Islamic Finance Committee (IFC), the Committee on Orang Asli Rights (COAR) and the Sub-Committee on Migrants, Refugees and Immigration Affairs (SMRIA). Through the HRC, COAR and SMRIA, he promotes and highlights the Bar’s position on human rights issues. These include repealing the ISA/EO, the death penalty and corporal punishment; strengthening data protection, privacy, freedom of assembly, expression and information, religious freedom; advocating fair and just treatment for women, children, persons with disabilities, indigenous peoples, migrants, refugees, asylum-seekers and minorities; ending human trafficking; and monitoring rallies. In 2011 Andrew represented SUHAKAM in 3 watching briefs before the courts; 2 on children’s rights and 1 on gender issues. He is also an independent consultant to SUHAKAM’s National Inquiry into the Land Rights of Indigenous Peoples, which will report in 2012. For both LPC and TiLSC, Andrew has been heavily involved in drafting and negotiating amendments to the LPA and creating rules for the establishment, licensing and regulation of international partnerships and registration of foreign lawyers. For the IFC, Andrew has worked to help organise and implement various events including the National Symposium on Islamic Finance. Outside of legal practice, Andrew is a member of the steering committee of BERSIH 2.0. He is also legal advisor to the Anglican Bishop of West Malaysia. Andrew was called to the Bar of England and Wales by the Honourable Society of Gray’s Inn in November 1991. He was subsequently admitted as an Advocate and Solicitor of the High Court of Malaya in May 1995. He has been a member of the Bar Council since March 2009. Proposers : Darryl Goon Yasmeen Shariff K. Mohan (3) BRENDAN NAVIN SIVABrendan Navin Siva is a B.Ec / LLB graduate of the University of Sydney, Australia and was called to the Malaysian Bar in 1999. Brendan is presently the Chairman of the Kuala Lumpur Bar and the Chairperson of the Court Liaison Committee, Bar Council. Brendan has also previously served the Bar in the following capacities: 2. Chairperson of the Professional Standards & Development Committee, Bar Council 2010/2011; 3. Co-Chairperson of the Professional Standards & Development Committee, Bar Council and Chairman of the Publications Committee, Bar Council 2009/2010; 4. For the last 3 years, he has been a member of and is currently the Deputy Chair of the Finance Committee, Bar Council. 5. Co-Deputy Chairperson of the Human Rights Committee, Bar Council 2009/2010; 6. Dato’ Loh Siew Cheang Proposers : Datuk Kuthubul Zaman Bukhari Dato’ Loh Siew Cheang Robert Lazar (4) GEORGE VARUGHESEWe have the distinct privilege of proposing George Varughese as a candidate for election to the Bar Council for 2011/2012. Currently George is the Chairman of the Small Firms Committee, a committee set up by the Bar Council for the very first time to assist small law firms in achieving their fullest potential. He has over the years contributed his time and energy to the Bar in various other capacities as detailed below :-
George is both humble and unpretentious. He is committed in his beliefs yet open to discussion, and more importantly honest and definitely not a seat warmer He is an asset to the Bar Council and deserves to be given the opportunity to continue with the good work and, we endorse and amply recommend that you cast your vote for George Varughese to be a Bar Council member for the year 2011/2012. TEJINDARPAL KAUR BC/T/1168 Proposers : Steven Thiru Ng Seng Kiok Tejindarpal Kaur (6) HONEY TAN LAY EANHoney Tan Lay Ean is an Advocate and Solicitor of the High Court of Malaya. She has an LLB from Buckingham University, and an LLM from Warwick University. She currently serves on the Family Law Committee and the Ad-Hoc Committee on the Common Bar Course of the Malaysian Bar, and is a Committee Member of the Malaysia Middle Temple Alumni Association. Besides being a Family Law practitioner, Honey is engaged in public interest litigation in the areas of equality and non-discrimination. Recently, she argued in the landmark case of Noorfadilla where the High Court ruled that discrimination based on pregnancy is gender discrimination, unconstitutional and contrary to the principles of the United Nations Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). She is also involved in the Muhamad Juzaily’s case dealing with violence and discrimination against Muslim transgendered persons; and Ambiga’s case regarding freedom of association in the judicial review of the Minister’s decision to declare Bersih 2.0 an illegal society. Within the last 12 months, Honey has made presentations at the 24th Lawasia Conference in South Korea, the UN Internet Governance Forum in Kenya, the Experts Seminar: Towards Achieving Substantive Gender Equality jointly organised by ASEAN and UN Women in Indonesia, the Selangor Bar on The Domestic Violence Act 1994: Protection For Survivors, and the 4th Lawasia Children & The Law Conference: The Child’s Voice in Cambodia. Kiran Dhaliwal Proposers : Derek Chong Ching Hsiang Tham Hui Ying Kiran Dhaliwal (7) DATO’ JAHABERDEEN @ JABARJahaberdeen or Jabar or Jahamy as he is known to his friends has been active in advancing social, national unity and human rights issues for years. He wears many hats and is ever willing to work with any group that promotes the general welfare of Malaysians without any partisan boundaries. Apart from having a busy practice with Messrs Jahaberdeen & Co, he has been active in the various Bar Council sub-committees over the years such the Human Rights Committee, the Syariah Law Committee and the Corporate and Conveyancing Law Committee. He has many times been appointed to the Disciplinary Committee and has chaired several hearings. For the almost 20 years that I have known him, he has been very consistent with his passion for the promotion of the humanistic face of Islam. In the 1990s, he was writing fortnightly for the Berita Harian on various issues from the Islamic perspective. Even today, he blogs his views on comparative religion and Islamic perspectives on his blog entitled “Journey To God” at http://jahamy.blogspot.com. He has travelled around the country with the movement “Saya Anak Bangsa Malaysia” delivering talks on “Human Beings born free and Equal from the Quranic Perspective”. He is an active member of several NGOs, including being an executive committee member of The International Movement for Just World (JUST). He supports movements such as Sabm and UndiMsia which among other things seeks to empower voters and young people. He also writes on various legal, political and social issues on his blog “Rapera” at http;//jahaberdeen.blogspot.com. He hopes to educate his blog readers on the importance of being a responsible citizen who will forever monitor the conduct of politicians in our midst. He has published a book touching on current issues entitled “Rapera: Urgently wanted”. He hopes that the book will encourage the rise of “savior citizens” or “Raperas” who can save the nation from the greed of the politicians. Again, the constant reference to the Quran in his book is characteristic of him. He strongly believes that freedom of thought is critical for the nation to develop. I have no hesitation is nominating him as I believe he will be a valuable contribution to the Bar. Fauzi Suzalena Binti Salleh (9) JUDE C. RAJLLB (Lond) Jude was admitted as an advocate and solicitor of the High Court of Malaysia in 1994 and since then, he has been actively involved in litigation. In the 17 years of experience that he has, Jude has appeared at all levels of the judicial system, including the Appellate Courts and the experience he has gained in the field of litigation has been tremendous. His expertise lies in the area of insurance law and he normally represents the insurance companies. He was a Legal Assistant with M/s Kanaga Suresh & Co where he continued to be in practice prior to becoming a partner of M/s Shan & Su in 2005. Jude is also an avid golfer who has represented the Malaysian Bar on numerous occasions. Jude was also a committee member of the Social and Sports committee of the Malaysian Bar. From being involved in the social activities of the Bar, Jude is now the chairperson of the Motor Insurance Review Ad Hoc Committee (MIRAC) and the Subordinate Court (Personal Injury) Working Group. He also represents the Malaysian Bar in the Joint Working Committee set up by Bank Negara to enhance the efficiency in Motor Claims Settlement Process. In addition, he is also a member of the Conditional Fee Committee. His involvement in litigation has been beneficial to his input in these committees and has also provided him with the exposure of meeting with regulatory bodies such as Bank Negara and the Attorney General’s Chambers as well as Members of Parliament, where he is able to put forward proposals and to identify practical issues that litigators would face in light of proposed changes that are being contemplated by the regulators and legislators. Proposers : Haji Sulaiman Abdullah Syamsuriatina Ishak Christopher Leong (11) LOW BENG CHOOBeng Choo graduated with LLB (Hons) from University of Malaya in 1982. She was admitted as an Advocate and Solicitor to the Malaysian Bar in 1983 and has been in practice since then. She is also a notary public. Whilst in practice, she obtained her Masters of Science in Information and Technology from University of Staffordshire, United Kingdom in 2002. Presently, she is a consultant with Messrs. Ranjit, Ooi, and Robert Low. Despite her busy schedule, Beng Choo would make time to meet with pupils who have completed their pupillage and who have called upon her to move their calls. Beng Choo has been an active member of the Bar Council having been elected annually from the floor since 1996. She had served as Chair of the Conveyancing Practice Committee, Court Liaison Committee, Cultural and Charity Committee and the Law Reform and New Legislation Committee. She continues to serve on the Conveyancing Practice Committee as Deputy Chair. Apart from Beng Choo’s passion and devotion to the legal field, she has also made a significant impact in the sports arena. Currently she serves as a vice-president of the Olympic Council of Malaysia, a post she has held since 2002. Beng Choo, with her continuous commitment and a wealth of experience, if elected, will be a valuable asset to the Malaysian Bar, as she serves without fear or favour. Proposers : Tan Weng Hung Adrian Oswald Woo Jiunn Jye (13) P. SUPPIAH1. Mr. Suppiah was called to the English Bar in 1959. Admitted as an Advocate and Solicitor to the Singapore Bar in 1960, Malaysian Bar in 1961. He is a very senior member of the Bar. Since then, he has been in active practice in Johore Bahru (except for five years – 1964 to 1969 – when he was a Legal Officer in the Malaysian Armed Forces holding the rank of Major). He was a Judge Advocate of the Malaysian Armed Forces for a while thereafter. 2. He was on the Bar Council in 1972, 1982 and 2003 to 2005 as Johore’s representative. 3. He has written a book on “Military Law”. He has about 52 reported cases in the Law Journals – civil as well as criminal. 4. He has been connected with football and golf. Still plays golf. 5. He has also written a book on “Football Rules”. 6. He was a Chairman of the Johore Bar for part of 2010 and represented Johore and the Bar Council. Date: 7th Oct 2011 DATUK DR ABDUL RAMAN SAAD Proposers : Abdul Raman Bin Sa’ad Philip Nainan Feruz Anwar Bin Seth (14) RAJPAL SINGHIt is with pleasure we propose Rajpal Singh as a candidate for election to the Bar Council for 2012/2013. Rajpal served as Chairman of Selangor Bar for a term of 3 years and is currently a Council Member and the Chairman of the Criminal Law Committee of the Bar Council. Rajpal Singh was admitted and enrolled as an Advocate and Solicitor of the High Court of Malaya in 1993 and has been in active practise for 18 years. Rajpal has contributed consistently to the Malaysian Bar in various capacities. He has represented the Malaysian Bar in several high profile criminal cases, sitting-in as watch brief counsel and also have been actively involved in several select committees on amendments to the Criminal Procedure Code, Evidence Act and various other acts. He also has represented and defended those arrested during the public rallies and have been active in Legal aid matters over the years. He has also in the past contributed his time and effort to the Bar as detailed below:-

Proposers : Syamsuriatina Ishak Haji Sulaiman Abdullah Edmund Bon Tai Soon (15) RAPHAEL TAYRaphael Tay was admitted and enrolled as an advocate and solicitor of the High Court of Malaya in 1986 and has been in active and continuous practice since then. He has been a notary public since 2007. He believes passionately that learning is a lifelong activity. It never ceases regardless of age or seniority and is his firm belief that continuing professional development is an integral part of professional life. With this same passion he serves on the Professional Standards and Development Committee of the Bar Council as it’s Deputy Chair. He is also a panel member of the Investigating Tribunal of the Disciplinary Board and is the current Chairman of the LAWASIA Moot Standing Committee. He also lectures pupils reading in chambers on behalf of the Bar Council and Ethics Committee. Raphael was also the Deputy Chairman of the 15th Malaysian Law Conference and the Chair of the International Malaysia Law Conference 2012. Raphael would like to give back to the Malaysian Bar what the Bar has unreservedly given him all these years. His will be a strong voice of reason and he will be undoubtedly an asset to us on the Council. Having worked with Raphael on many occasions, I can truly attest to his capability and passion in pursuit of a better Malaysian Bar. Proposers : Andrew Khoo Chin Hock Christopher Leong Syamsuriatina bt Ishak (16) RICHARD WEE THIAM SENGRichard Wee has served the Bar since 2005. Amongst the positions and projects that he has been involved in are as follows:-
Recently, Richard Wee was a member of the Royal Commission of Inquiry, investigating Teoh Beng Hock’s Death, and is currently a member of the Bar Council’s Team at the SUHAKAM Inquiry of Bersih 2.0’s Rally in July 2011. Proposers : Roger Tan Kor Mee Anand Ponnudurai Roger Chan Weng Keng (17) ROGER CHAN WENG KENGI know from my years of association with Roger Chan Weng Keng that he is a true human rights (HR) defender who has worked unceasingly and ungrudgingly for the Bar in many of its HR causes Roger has all the attributes to champion the underdog. He is of gentle disposition, but I have seen him raised his voice many times against injustices and abuses of the poor, disadvantaged and marginalized communities. He has taken up many socio-economic and poverty issues of the urban poor through the Human Rights Committee (HRC), of which he serves as Co-Deputy Chair since 2009 until present. In the Kampung Papan case for example, when the powers that be invoked the draconian Emergency Ordinance to evict 115 families, Roger came to the villagers rescue to slug it out with the authorities in and outside court for years, to finally ensure the right of a roof over their heads. Roger has also represented the Bar Council (BC) and family members in the many inquests into death in police custody cases. He is a person you can rely on in monitoring or urgent arrest work concerning those who were abused or arbitrarily arrested for exercising their rights to peaceful assembly. He is a familiar face in many of the Suhakam Public Inquiries into violation of human rights and allegations of excessive use of force or abuse by law enforcement personnel, amongst them the Bloody Sunday Incident, Cheras Mahkota Incident and Arrest of Lawyers. He is in the team of observers from BC on the on-going Suhakam’s Bersih Public Inquiry. He has also on behalf of HRC taken on defence work for marginalised groups charged with protesting at KLCC in 2008 on fuel hike, on the basis of their human rights and constitutional freedom to speech and expression. The need to raise awareness of HR issues at the Bar, has driven Roger to organize workshops and seminars at national and state bar level since 2006. Last year he led a committee on Project Threshold to train the trainers and bring human rights to states such as Melaka, Selangor, and Kelantan. Roger chairs the Environmental and Humanities Committee (EHC) of the Kuala Lumpur Bar since 2009. He is also the Co-Chair of the Environmental and Climate Change Committee (ECC). This year he led the EHC and ECC to meet with Kuantan residents to discover first hand the potential environmental threat of radioactive waste disposal and violation of their rights to information from the authorities concerned. Last year EHC through their first climate change forum opened the way for the Bar and public to consider the efficacy of current Climate Change agreements and the unimaginative international framework that could hamper Climate Change work, and threaten international peace and security. Recently he led members of ECC to monitor Himpunan Hijau 109, a solidarity gathering of 10,000 people at Taman Gelora, Kuantan, held to highlight some of the very serious environmental issues in this country as well as to endorse the principles of the Earth Charter. Roger is an asset to the Bar and I recommend him for your consideration. Proposers : Saha Deva A. Currently serves as the Perak Bar representative and the Co-Chairperson of the Syariah Laws Committee of the Bar Council. She has untirelesly served the Malaysian Bar and the Bar Council for a continuous period of 14 years in the Syariah, Environmental, Mediaton and Islamic Finance Committees. She has also served the Perak Bar Committee for 12 years. She has faced and withstood the challenges in the promotion improvement and betterment of the working environment and administration of justice for legal practitioners and the public both in the Civil and Syariah fields. Proposers : Nur Asikin Abdul Rahman Junainah Abd Lateb Haji Mad Diah Endut (19) STEVEN THIRUSteven Thiru is currently the Treasurer of the Malaysian Bar , the Chairman of the Finance Committee , Chairman of the Ad-Hoc Committee on the Common Bar Course ( CBC ) , the Co-Chairperson of the Committee on Orang Asli Rights and a Committee member of the Industrial Law Committee. He is also a Committee member of the Lawasia Sub-committee on Labour Law and a Council member of the London based Commonwealth Lawyers Association. Steven has served the Bar for many years and has now been a member of the Bar Council for four terms. In the late 1990’s , both of us served in the Human Rights Committee . We later served in the Continuing Legal Education and the Professional Standards and Development Committee. We share a passion for legal education and enhancing the standards of law students, pupils and practitioners. Steven was the Chairman of the Kuala Lumpur Bar Continuing Legal Education Committee (two terms) and later the Chairman of the Professional Standards and Development Committee of the Bar Council (also for two terms). He currently chairs the Ad-Hoc Committee on the CBC that drafted the Bar Council’s CBC scheme and recently co-organized the Bar Council ‘s conference on legal education in Malaysia ( “ Qualifying for the Bar ; Standards Across The Jurisdictions “ ) Steven is also involved in the protection and defence of Orang Asli rights . He represents Orang Asli litigants. We were together in the team of lawyers in the landmark Orang Asli land rights case of Sagong Tasi, which was also undertaken on a pro-bono basis . We share a deep conviction for the plight of the Orang Asli and we subscribe to the enduring words of Justice Michael Kirby “The law matters most when it is called in aid by minorities and unpopular people. It is relatively easy for the law to protect the majority and the popular”. Steven is currently the Co–Chairperson of the Committee on Orang Asli Rights, a dedicated committee of the Bar Council that handles a whole host of issues concerning the Orang Asli in West Malaysia. Steven graduated in 1990 from the University of Leicester. He was admitted to the English Bar at Middle Temple in 1991 and the High Court of Malaya in 1992. He also holds a Masters in Laws degree from the University of Malaya. He is currently a litigation partner of Messrs Shook Lin & Bok. I have had the privilege of working with Steven in a number of cases. He is a conscientious and persuasive advocate. He continues to combine his active civil litigation practice with public interest and minority rights cases , and the various positions he holds in the Bar Council. In 2009, he was appointed as Co-Deputy Chairperson of the Bar Council Constitutional Law Committee (“BCCLC”). That year, BCCLC launched the MyConstitution campaign aimed at educating the citizens of Malaysia on the Federal Constitution and constitutionalism. He served the post for two terms. He currently serves as Chairperson of BCCLC and continues the work of the MyConstitution campaign to merakyatkan Perlembagaan for the third year. At State Bar level, Syahredzan was elected as a Committee member of the Kuala Lumpur Bar Committee in 2011 and is Chair of the Information Technology and Communications Committee of the Kuala Lumpur Bar. As a young lawyer, Syahredzan also serves the Bar Council National Young Lawyers Committee and has further been an active member of the Kuala Lumpur Bar Young Lawyers Committee since 2009. In addition, Syahredzan has been involved in a number of public interest litigation cases relating to constitutional and human rights. Tina, as her friends fondly call her, has been an active member of the Bar for some years, devoting her time to serve on numerous Bar Council committees. Sulaiman Abdullah Proposers : Haji Sulaiman Abdullah Ambiga Sreenevasan Chow Siew Wai (23) TAN PEEK GUAT I, Chee Beng Wah, have known Madam Tan Peek Guat since the year 1995. Madam Tan Peek Guat was a school teacher, and she taught at the school near to my office at Damansara Utama for many years. Since she was keen to be a lawyer, she then decided to take up law studies at the Bond University in Australia. Ms Tan was a dedicated school teacher and worked long hours to assist the students in their studies. As a lawyer, she is concerned about the development of our social norms and devoted much of her time towards commenting on the issues at hand and used to offer her opinions on many articles appearing at the Malaysian Bar Website. I nominate her to be a member of the Malaysian Bar Council as I strongly believe that she would then be able to devote much of her time and contributions towards the concerns and interests of our small lawyers among us. Proposers : Ng Kong Peng Hendon Mohamed Christopher Leong (25) DATO’ YASMEEN SHARIFF It gives me great pleasure to nominate Yasmeen Shariff for election as a member on the Malaysian Bar Council for the term 2012-2013. Yasmeen served the Kuala Lumpur Bar Committee as a secretary and executive member for 8 years with great commitment and dedication. She then took on the challenge to serve the Malaysian Bar as a council member. I have known her for many years and I am impressed with the level of commitment and passion she has shown for her NGO work. She has lobbied for many changes for Women and Children. Her latest achievement is introducing alternatives to custody for children in conflict with the law. On Children’s Day in October 2011, the relevant Minister spoke of implementing alternatives to custody for minor offences. Currently she serves on a Special Committee on Remand for Children (set up to look into places of remand for children to ensure that they are Child friendly and comply with the relevant Laws and Conventions). At the Bar Council she has served on the National Legal Aid Committee, Law Care Committee (chair), Bahasa Malaysia Committee, Law Reform Committee, Family Law Committee, Syariah Committee, Court Liaison Committee, and Malaysian Law Conference Committee, Human Rights Committee and Islamic Finance Committee (Chair and Deputy).
