Can a service provider collect rental after disconnecting a customer’s line?

A READER has a query regarding the disconnection of telephone lines. He says that when a person’s telephone line has been disconnected, the following message is heard when he picks up the phone: “Sorry, your fixed line has been temporarily disconnected. Please settle your bill and call 100 for reconnection.”

He wants to know if the providers of telephone services (which I shall refer to as service providers) can continue charging rental even after disconnecting a subscriber’s line? If so, on what basis can they do so?

A customer in such a situation may feel aggrieved that he was billed during the period when he did not have the full benefit of the facility.

The provision of a telephone line by the service provider to the customer is a purely contractual arrangement entered into between the parties. What the customer is entitled to and what his obligations are, depends on the contract that has been entered into.

MCA president Datuk Seri Dr Chua Soi Lek has challenged Pakatan Rakyat to include its stand on hudud and its implementation in its general election manifesto and common agenda.

Pakatan, especially PAS, he said, should be transparent in its stand.

“Right now, there are conflicting signals from Pakatan leaders. Hudud should be in their common agenda since they always never do anything without consulting their partners.

“If the rakyat votes for PAS, DAP or PKR knowing full well that they will implement hudud law, then we should respect it as it is the voters' choice,” he said at a forum entitled “Hudud and its Implications on Non-Muslims in Malaysia” yesterday.

KUALA LUMPUR, Dec 5 — Putrajaya’s speed in passing a new law that bans street demonstrations has stunned the Bar Council and the Human Rights Commission of Malaysia (Suhakam) who revealed they were given a far different account of its contents at the draft stage.

The two statutory bodies disclosed too that Attorney-General Tan Sri Abdul Gani Patail had sought their views over the controversial Peaceful Assembly Bill but failed to provide them with written copies of the draft before its tabling in Parliament last November 22.

“The Bar Council was not given a copy of the Peaceful Assembly Bill during the consultation stage,” its president Lim Chee Wee told The Malaysian Insider when contacted over the weekend.

He said there were good reasons why the copy was not provided, but could not disclose these because they had sworn to keep it confidential.

PETALING JAYA: The Barisan Nasional government is determined to keep the country's peace and stability through teamwork among the races, said Deputy Prime Minister Tan Sri Muhyiddin Yassin.

In assuring the Chinese community of this, he said this included sharing of political power and cooperation in the economic field.

“The Government is responsive and attentive to the welfare and happiness of its citizens and is always ready to hear views from them, regardless of their race or religion,” he said at the Federation of Chinese Associations Malaysia's (Hua Zong) 20th anniversary dinner and central committee oath-taking ceremony last night.

THE effects of hudud law on non-Muslims are very real.

International Movement for a Just World president Prof Dr Chandra Muzaffar said parties that subscribed to hudud should not be empowered.

He said most countries which adopted hudud law had failed to protect their people or their rights.

“What is the meaning of hudud if there is so much corruption at the top but there are strict rules at the bottom?” he said, adding that some had a very narrow interpretation of hudud.

MALAYSIA is a secular country and anyone who wants to change the laws should remember that it should not be restrictive or affect the rights of any community, lawyer Philip Koh said.

He noted that every faith may have ideas as to how it wanted the laws to be framed to govern society, but it should not impede the rights of those of other faiths.

Koh said the Reid Commission, which was the basis on which the Federal Constitution was formulated, clearly stated that Malaysia is a secular nation.
 
Abolish death penalty, says lawyer E-mail

A LAWYER has called on the Government to abolish the death penalty and other forms of capital punishment if it opposes hudud law.

Edmund Bon said certain forms of punishment under hudud law such as amputation was cruel and inhumane, and similar to whipping and the death penalty.

“If we are against punishment that allows amputation, then abolish all capital punishment as well,” he said at the forum.

Otherwise, he said all arguments against hudud law would fall flat.
